It was exactly what they wanted. I was shocked.”
They cleared the home. After ATF’s SWAT team cleared Fincher’s home, they called the agent in charge of the raid — Special Agent Theodore Mongell — and told him it was “safe to come up.”
To clear a home you have to be INSIDE the home and have done a room to room search. Is that clear to you now. So they were INSIDE HIS HOME.
But being on the porch is no different because the SCOTUS has ruled that the porch is part of your home's curtilage and they have no right to be there without a warrant. They can do a knock and talk but no more.
