It seems like every new regulation that says “costs should be recouped over a period of time” prove to be government malarkey. Everything always costs more than they say it will. Many of us live on fixed incomes, so what are we supposed to do? Maybe if we could just get rid of the Bidens in this government & get some return to honesty some of this lying would stop. Hoping strongly that this next election will put a stop to some of this.

A.L.A. Schechter Poultry Corp. v. United States, 295 U.S. 495 (1935), was a decision by the Supreme Court of the United States that invalidated regulations of the poultry industry according to the nondelegation doctrine and as an invalid use of Congress’ power under the Commerce Clause. This was a unanimous decision that rendered parts of the National Industrial Recovery Act of 1933 (NIRA), a main component of President Franklin D. Roosevelt’s New Deal, unconstitutional.

There were originally 60 charges against Schechter Poultry, which were reduced to 18 charges plus charges of conspiracy by the time the case was heard by the U.S. Supreme Court.

Ten charges were for violating codes requiring “straight killing”. Straight killing prohibited customers from selecting the chickens they wanted; instead a customer had to place his hand in the coop and select the first chicken that came to hand. There was laughter during oral arguments when Justice George Sutherland asked, “Well suppose however that all the chickens have gone over to one end of the coop?”

The Schechter brothers were Jewish (the surname Schechter means “slaughter” in Yiddish, and specifically refers to a ritual slaughterer). According to the trial record, at least some of their customers preferred to select individual chickens, believing that this made it easier to have their rabbi certify the chicken as kosher.

Chief Justice Hughes wrote for a unanimous Court in invalidating the industrial “codes of fair competition” which the NIRA enabled the President to issue. The Court held that the codes violated the constitutional separation of powers as an impermissible delegation of legislative power to the executive branch. The Court also held that the NIRA provisions were in excess of congressional power under the Commerce Clause.

The Court distinguished between direct effects on interstate commerce, which Congress could lawfully regulate, and indirect effects, which were purely matters of state law. Though the raising and sale of poultry was an interstate industry, the Court found that the “stream of interstate commerce” had stopped in this case – Schechter’s slaughterhouse’s chickens were sold exclusively to in-state buyers. Any interstate effect of Schechter was indirect, and therefore beyond federal reach.

Though many considered the NIRA a “dead statute” at this point in the New Deal scheme, the Court used its invalidation as an opportunity to affirm constitutional limits on congressional power, for fear that it could otherwise reach virtually anything that could be said to “affect” interstate commerce and intrude on many areas of legitimate state power. The court ruled that the law violated the Tenth Amendment.

‘Appliance standards are an unsung hero in our work to address climate change and transition to wiser energy use,’... Yeah, the Chicoms will applaud this because they figure some will actually believe it. First of all, there is
little need to address climate change...we need to ADAPT to it; something we did fairly well until the Obama & Biden administrations came along. Who is in charge of the climate? Certainly not the government. Who is trying to force us into “wiser energy use”? Certainly that IS the present government, because they know their policies will force us into dealing with less available energy. The people doing this to the public need a new home...maybe Mars.

And dishwashers. You cannot find a washer or dishwasher that cleans very well anymore. Neither uses enough water to properly clean. By the time you prewash everything, or rehash everything 2-3 times, you’ve used way more water and electricity than the older, “non efficient” units used.

Here’s a quick summary, based on my understanding from spending a bunch of time in the plumbing business:

ON DEMAND GAS
Needs electricity and of course gas to operate, no hot water storage. For retrofit, requires large gas service capacity. The electricity required is small, just a conventional 15 or 20 Amp circuit to run the controls.

ON DEMAND ELECTRICITY
Needs electricity, no hot water storage. The electrical feed needs to be 150 Amps for decent performance (36 kW unit), which means doubling (or more) the size of the service coming in from the utility, for a retrofit...or having a much larger electrical service than otherwise needed for a home. Either way it’s pricey, so not too many of these sold.

TANK, GAS HEATING - CONVENTIONAL
Only needs gas (operates during blackouts). Water also stays hot for at least 24 hours in most conditions.

TANK, GAS HEATING - CONDENSING
Needs gas (of course), but also needs electricity to run a small fan. Water also stays hot for 24+ hours. If you want a tanked gas water heater, you will soon be required to buy this type.

TANK, ELECTRIC HEATING - CONVENTIONAL
Operates at relatively medium power, about 6 to 7 kW (30 Amp circuit). Water also stays hot for 24+ hours. Can often be retrofitted to an existing home without requiring service upgrade...but not always.

TANK, ELECTRIC HEATING - HEAT PUMP
Also operates at medium power, with a 30 Amp circuit, so no problem with replacing an existing conventional electric water heater, and often can be retrofitted without a service upgrade (in the place of a gas unit)...but you will still need a new circuit installed. This type of unit is just an air conditioner running in reverse, so if your basement isn’t already cold enough, it will be with this unit running (LOL). Also keeps water hot, of course. This is what you’ll have to be buying in the future if you want a tanked electric water heater.

For you survivalists out there (keep in mind that only the tank units store hot water):

ON DEMAND GAS
Can operate if gas is available, plus a small generator for electricity (probably 1kw is enough, but be sure to check)

ON DEMAND ELECTRICITY
Needs utility power unless you have a huge generator (as in commercial unit)

TANK, GAS HEATING - CONVENTIONAL
Will operate normally with only gas available

TANK, GAS HEATING - CONDENSING
Will operate with gas available and a small generator (2.5 kW and above).

TANK, ELECTRIC HEATING - CONVENTIONAL
Will operate with a medium sized generator (10 kW will work)

TANK, ELECTRIC HEATING - HEAT PUMP
Will operate with a medium/large generator is available (15 kW minimum as the start-up power is high) - think medium sized central air conditioner power level.

Central planning worked just as it was intended to. It gave vast power to the government bureaucrats it forced the proletariat (we refer to them as citizens) to follow the ignorant ideas of the bureaucrats. It stifled consumer choice. And it provided hordes of government employees with sinecures. What it didn’t do was provide a quality of life for the average citizen anywhere near what capitalism’s and free market does, but that was not and is not the intent of central planning.

Democrats and the brain dead fools who vote for them are apparently fully in tune with lowering the USA quality of life to the lowest level for the bulk of the citizens believing that they will keep all of the things that they enjoy. Steak for them crickets for us. Chauffeured limousines for them public transport for us. Heat and air conditioning for them freezing and sweating for us. Loot steal and murder without serious consequences for them. Serious prison time for defending your life and your property for us. Etc.

The destructive war on appliances can best be understood when realizing that Democrats at their core are miserable, unhappy people. When they have power, they are repulsed by anyone that seems to be prospering or content. Democrats should not be tolerated by decent, rational people.

People will go to replace their water heater and will find the same nominal capacity will no longer fit in the utility closet. So instead of a 40 gallon water heater, you’ll end up with a 30 gallon. This “improvement” in your life brought to you by FedGov bureaucrats who have never had to install a replacement water heater.

When I replaced my air conditioning, I saved maybe $100 a month by spending $9,000. It took a long time to recover this investment. (the old air-conditioner had to go anyway, but)
