Turley: Jack Smith Needs More Evidence Than Trump's Speech To File J-6 Charges

FOX News legal analyst Jonathan Turley comments on reports that former President Trump will be indicted again over his actions or nonaction around January 6, 2021:

"JONATHAN TURLEY: This is a step that usually will come towards the end of an investigation when you receive these types of letters, it gives your client the opportunity to appear in a grand jury. They are never a welcomed thing to receive. Usually, a target letter is before you receive an indictment, that's not necessarily the case. But it is viewed that way by most criminal defense attorneys. These letters often tell the target that they need to preserve evidence, that they need to look at counsel. That they have a set period of time where they can appear before the grand jury.

The concern here is that the special counsel could be proceeding on a case that might be constitutionally challenged. If the case is built around Trump's speech on the on the ellipsis on Janua 6, I don't believe that it could withstand judicial review. The question is, does Smith have something else? Something that's a direct link to a conspiracy or effort to cause violence? We haven't seen that. The January 6th committee in Congress came up with nothing as a direct nexus to that type of evidence."

This is prompted by a comment by someone posting on another thread to the effect: "Trump has to prove he is not guilty of what he is accused of"

That is completely wrong, and a Leftist viewpoint (unless the Leftists themselves are on the receiving end). The burden of proof is on the prosecution, as Turley implies.

But lets take it further.

If this affront is allowed to stand, either by Leftists and the corrupt who have ZERO regard for our Republic, or by political entities who deem it convenient for purposes of their own ambitions (I suppose that still falls into the corrupt category), NO one is 'safe'.

As for those in the RNC who are content to sit back and let it happen, I agree with Julie Kelly's sentiment that Jack Smith can indict any Republican in DC, and just may do so if they don't 'toe the line'.

As for the Left? Look up Martin Niemoller. There's this wonderful thing called the Internet if your stupid a**es can be bothered.

Big deal. Right now he is committing prosecutorial misconduct by investigating and accusing Trump with NO stated evidence of PROBABLE CAUSE that Trump committed a crime.

No, he does not. In the Post Constitution United States, political crimes are adjudicated in advance and in the media.
Trump has to prove his innocence beyond any shadow of doubt, not only in court, but in the media. An impossible task since the verdict is already in.
At this point in time what the Uni-party & the Deep State are praying (to whom, I do not know) is for some court to rule that President Trump is ineligible to run for public office.

You are naive if you think Smith is abiding by legal and judicial precedent. He is a snake with a law degree. Has been overturned in one case by a unanimous Supreme Court ruling.

I believe this is about the electors.

Smith will probably allege criminal fraud. However, that is absurd, Pence’s job was on the line and Pence was fully aware of all relevant matters.

Trump’s lawyers can be expect ted to put Pence on the stand and Pence will be asked questions.

Did your ticket with Trump lose in Michigan?

I believe so, and that was certified by the legally designated officials of Michigan.

Was your ticket with Trump cheated in Michigan?

I’m pretty sure there were election irregularities that were in Joe Biden’s favor.

Legalities don’t matter one bit. Until they find a way to permanently deal with Trump the harassment will go on and on. Right now they seem to be angling for a jailhouse “accident”. But trust me I think both Trump and RFK jr have caused enough concern they each have a bullet with their names waiting.
