Update Regarding Makana Masacayan, Española Valley High School special-education teacher arrested for sexual relationship with teen

A former special education teacher at Española Valley High School pleaded no contest in state District Court in Tierra Amarilla to three charges stemming from an incident in which she was accused of sexually assaulting a teenage student.

Makana Masacayan, 26, was arrested in June of last year and initially was charged with fourth-degree criminal sexual penetration, fourth-degree criminal sexual contact of a minor, contributing to the delinquency of a minor, and enticement of a child.

Masacayan appeared in court wearing a mask and stood next to her attorney, Dorie Biagianti Smith, while entering her plea. She accepted a plea deal under which the rape charge was dismissed, and she was sentenced to three years of supervised probation on the remaining counts.

During the hearing, Biagianti Smith said that her client plans to return to her native Philippines as soon as possible since her work visa was revoked after she was criminally charged.

The attorney added that Santa Fe County Magistrate Court took possession of Masacayan’s passport, which has prevented her from moving back to the Philippines.

I read that part and had no idea what that means or why there would be a picture of it.

Fourth-degree is pretty low, right? Me, just thinking out loud here, but if something is penetrated it either is, or it is not.

What are we talking about here? I mean maybe she left a stool upside down and he was on a ladder hanging finger paintings and then.... well, nevermind. Weird story is all.

Yes, Los Alamos Labs is just up the road from Espanola. Some of the most well educated technical people in the world have worked there. But Espanola is ChoLow City.

The Espanola jokes were so common, the Lab made it a dismissal offense to tell one. I’m sure they went home and told them. Smile.

In other words, a pedophile.
Pedophiles have no redeeming qualities.
They can’t be rehabilitated.
Kill them.
And those that enable and support them.

A little over 20 years ago I used to train the IT people at the lab. Los Alamos is a curious place. They roll the sidewalks up at 9:00 pm, and there seem to be a lot of Chinese restaurants there for such a small town.

I have my own Espanola “joke.”
We were passing through there on our way to Taos one time, and we stopped at the McDonalds so kids could use the restroom and we could get coffee. I pulled into a parking space and the guy behind me started honking at me. He thought I had parked in the drive-thru lane that was 30 feet further over.

Yep. Espanola is like that.

Los Alamos and Espanola cultures are light years apart.

The first step - the school district offers a cash settlement.

No attorney - the parents and the teenager keep 100%.

If they think the settlement is too small, then they hire an attorney, who can get up to 40% in some states.

The settlement will come within a few months and have limited or possibly zero publicity.

A civil trial and appeals can take years, and there is always the possibility the plaintiffs can lose.
