Texas AG Paxton slams 'Soros-backed' prosecutor after jury convicts Army sergeant for shooting protester

Texas Attorney General Ken Paxton is lashing out at a "Soros-backed" prosecutor after a Lone Star State jury found Daniel Perry, a U.S. Army sergeant, guilty in the shooting death of an armed protester in Austin during anti-police demonstrations in the summer of 2020.

"Self-defense is a God-given right, not a crime. Unfortunately, the Soros-backed DA in Travis County cares more about the radical agenda of dangerous Antifa and BLM mobs than justice," Paxton said in a statement to Fox News Digital.

The shooting involving Sgt. Perry occurred during Black Lives Matter demonstrations that erupted across the Texas state capital and the rest of the United States nearly three years ago.

Perry, who was stationed at Fort Hood at the time, was driving for Uber to make extra money in downtown Austin on the night of July 25, 2020, when he encountered a large crowd of protesters. They were illegally blocking city streets that night, according to police, as protesters in Austin and elsewhere had done during the weeks of rioting.

No, not on his own he can't.

"The Governor has the authority to grant clemency upon the written recommendation of a majority of the Texas Board of Pardons and Paroles (Board)."

Ok, is he calling an emergency meeting of that board today? Has he made a single public statement of outrage? Has he directed the AG or the Rangers to open a criminal investigation into witness tampering?

Has he done a single thing?

Combine that with the self serving and cowardice of the Republican party, and you have a real problem.

And while we deal with the immediate problem of this unjust conviction, let’s look further back. Abbott could have called out the National Guard to put down these riots in the first place. Let riots slide and other bad things happen.

He found time to send them to DC after January 6th.

Yeah? Cool. So has he done a single thing to get that board moving? Has he said a single word? Has he had the AG launch a criminal investigation into the DA’s witness tampering? Has he called an emergency meeting of that board?

Nada... silence. A good man is in prison tonight, and he hasn’t made a move to fix the problem he himself created by not lifting a finger to stop the riots.

You bet it is. He let the BLM riots run wild and didn’t lift a finger. Not a single effort to stop them. National Guard wasn’t called out. Then he did nothing about this witness tampering DA despite the lead detective screaming to high heaven about it.

Democrats are just being democrats. But they would be powerless if Texas Republicans lifted a finger. That make the Republican party the main problem. And in this moment, Abbott hasn’t said a word or lifted a finger.

And then of course, this is that same Abbott who let Texas DPS launch SWAT raids with a tank on a restaurant that dared to stay open during covid.

But go ahead and say it’s democrats, and the republicans are our protectors if that helps you feel better.

If you are getting beaten up at an ATM, and a cop is sitting in his car doing reports and doesn’t get out and intervene, who is the real problem in your society? The guy beating you, or the cop watching it ... and doing nothing?

You are correct, I remember how much crap they gave GWB about his refusal to pardon that murdering female whose name started with a K, I think? And somehow the media never brought up the fact that Texas governors can only pardon people with permission from the state parole board. I had to learn that here.

The Governor appoints the Texas Board of Criiminal Justice. I would assume that the Board and its appointee the Director could at a bare minimum provide the convicted Sergeant with the most cushy possible conditions of confinement pending a successful appeal or pardon.

Why do people assume that the law works the same way in every State? Governor Abbott does not have unlimited pardon power.

Article 4 Section 11: “In all criminal cases, except treason and impeachment, the Governor shall have power, after conviction, on the written signed recommendation and advice of the Board of Pardons and Paroles, or a majority thereof, to grant reprieves and commutations of punishment and pardons; and under such rules as the Legislature may prescribe, and upon the written recommendation and advice of a majority of the Board of Pardons and Paroles, he shall have the power to remit fines and forfeitures. The Governor shall have the power to grant one reprieve in any capital case for a period not to exceed thirty (30) days; and he shall have power to revoke conditional pardons. With the advice and consent of the Legislature, he may grant reprieves, commutations of punishment and pardons in cases of treason.”

The Texas Governor can only pardon someone AFTER the Board of Pardon and Paroles recommends it.
