Sure. People always sexually assault other people bundled up in ski gear, out in the open, on ski slopes. And slamming into somebody from the rear is the most common type of sexual assault on the slopes.
If this guy is after her wealth, he didn’t ask for a lot. With potential head injuries, he could have sued her for millions. $300,000 seems more like a settlement amount to avoid court.
Even though the eye witness testified in detail that it was totally her fault and she took off and left the scene. ๐
Having skied for many years, and had more than my share of wipe outs... tho only once involving another, I’d say if his skis were between hers and they both fell, for him to be face down in the snow would mean she would have to be under him. But instead, she landed 10 feet away somehow.
The most likely result would be her hitting him, him falling face down, and her ending up 10 ft away. Anything else would require serious contortions.

Sanderson’s witness’s account is plausible which Paltrow’s account is pretty far-fetched.
Does Sanderson have the โpreponderance of the evidenceโ (i.e., that it is more likely than not) that the defendant is responsible for the harm the plaintiff has suffered? Looks like it to me, at least from what is written here (although I think Paltrow is a cutie or at least looked like it in Iron Man).
Not sure the Plaintiff’s $300K for his injuries (if the injuries are true) is “exploiting her wealth.”

If she did run into him, then it's likely she wasn't a very proficient skier especially since she was with an instructor but not worthy of a lawsuit since such collisions are very common.
If lawsuits like this became commonplace then I would expect ski resorts to resort to demanding skiers show proof of liability insurance at the time they purchase their tickets or include their own insurance added to the cost of the daily ticket.
Um, collisions happen when skiing. Iโve been wrecked twice. One put me in the hospital. Didnโt sue anyone. Part of the risk. Sheesh.
Unfortunately, there are going to, very likely, be the “bigbob” jurists; those who are broke themselves, envious, touting a “victim” mindset and/or just mentally lazy - and therfore believe wealthy persons should be commanded to just pay up - based on their presumed means and regardless of the facts of the case.

Having grown up on a ski mountain whomever is above and slams in to a person below is responsible for the crash. Worst accident I saw was an idiot going hell bent for a jump and killed a guy when his skis nearly decapitated the downhill skier.
If Paltrow crashed in to him from above... Pay up.
