The government generally brings criminal charges in one of two ways: by a “bill of information” secured by a preliminary hearing, or by a grand jury indictment. In the federal system, cases must be brought by indictment. States are free to use either process. Both preliminary hearings and grand juries are used to establish the existence of probable cause. If there is no finding of probable cause, a defendant will not be forced to stand trial. An indictment is usually sealed so the offender doesn’t know he’s going to be arrested at some point in the future.
According to CNN, President Trump’s indictment hasn’t even happened yet. CNN Politics reported today that “Another witness is expected to testify Monday before the grand jury investigating the hush money payments, according to a source familiar with the investigation. It is not clear whether this would be the final witness before it votes on a possible indictment.” If the indictment hasn’t even happened yet, then PDJT’s indictment can’t be sealed, so this isn’t the indictment referred to in Q drop 3716.
Having said that, the second line of the drop may very well be referring to President Trump. If he’s arrested on Tuesday following his indictment on Monday, this would confirm that former Presidents can be arrested and prosecuted for criminal activity. Then perhaps the sealed indictment against a different president becomes unsealed. There’s no reason to believe that these two sentences in the drop are related to the same person or activity, and it would be just like Q to make a drop that conflates the two ideas to create necessary uncertainty, or even false certainty.
