No, it's not going to be upheld. If the IL Supreme Court doesn't strike it down, the 7th Circuit Court of Appeals has already said they're not going to dick around like the 2nd Circuit Court is in NY State.

I would add that the AA candidate Attorney General's claim is simply wrong: the rational basis test no longer applies, at least in Federal Court: it should be history & tradition.
