I don’t know who’s right or who’s wrong in this situation, but I do know this. Both parties at a table should not leave to go to the restroom at the same time. Someone needs to stay behind so situation like this do not happen.

It depends on whether they left partial drinks behind. If the bartender had cleared things, the seat became open.
