Key element is the driver must be operating a motor vehicle.
I think the DUI is pretty lame, too. It is overreach for the police. He must have broken plenty of laws riding where he was and ignoring police. Stick to what he actually did, which might include public drunkenness, but does not include operating a motor vehicle.
You can get a DUI on a bicycle. The Hollywood police department explained it to me.
A number of people have lost their liscense on a horse DUI, I think its ridiculous but it is what it is.

The late Ray Bradbury didn’t drive and once got a ticket for being drunk and in charge of a bicycle.

Riding a horse drunk maybe idiotic but doesn’t warrant a DUI, nor does it on a bicycle, lawn mower etc. Drunk in public maybe but that’s it.
