Two Atlanta Police Department officers will not face charges in the fatal shooting of Rayshard Brooks, who was killed two years ago outside a Wendy's restaurant, after a prosecutor said 'their deadly force was reasonable.'
Officer Garrett Rolfe fatally shot Brooks, 27, twice in the back as he ran from cops outside the fast food store in South Atlanta in June 2020. The officers were trying to arrest him in the parking lot.
Rolfe and his colleague, Officer Devin Brosnan, were initially called to the restaurant by customers who said a man was asleep at the wheel, blocking the drive-through.
Brooks' death sparked fierce protests at the time - having occurred just weeks after George Floyd was killed in Minneapolis. The Wendy's that Brooks was shot dead at was burned to the ground by protestors the following day.
But now, the amount of deadly force used by the cops has been deemed 'reasonable' and the case has been dropped.
Pete Skandalakis, executive director of the Prosecuting Attorneys’ Council of Georgia, made the announcement on Tuesday.
Skandalakis said: 'Based on the facts and circumstances confronting Officer Rolfe and Officer Brosnan in this case, it is my conclusion the use of deadly force was objectively reasonable and that they did not act with criminal intent.'
Brosnan was previously charged with aggravated assault and violating his oath, and Rolfe faced 11 counts over Brooks' death, including felony murder.
Brooks had fallen asleep at the wheel in a drive-thru line for about 40 minutes - and when the officers attempted to arrest him on a DUI charge, he resisted.
The man consented to a portable field alcohol test and it was returned with a result above the legal limit of .08 blood alcohol content.

You don't spit into the wind
You don't pull the mask off that old lone ranger
and most of all, you don't try to steal the Po Pos tazer gun!
Finally some decent news.
[The Wendy’s that Brooks was shot dead at was burned to the ground by protestors the following day]
Which, of course, makes perfect sense.
Or something.
True. I don’t understand how there could be anyone that sees it differently.
It’s pure insanity.
The case was useful, which is why it took so long in absolving the officers.
So when does the riot start?
More importantly, when does the Wendy’s that they built to replace the destroyed one get burned down?
(Sorry, thought that was the obvious go-to)
CC
Why der no jobs in in the neighborhood they ask while standing in front of the ruins of a Wendy’s they burned for no reason.
About time. IIRC the same DA who said a Taser was deadly force and tried to charge a officer for using it on a BLM protester said in this case less then a moth later the perp who stole and tired to tase the officers who shot him that a Taser is all of a sudden not deadly force.
Here comes the Federal prosection from Garland’s InJustice Dept.
Right away. And through Election day.
Exactly
Good point
Just like what happened to the officers who restrained Rodney King in California: acquitted under state charges, then tried and convicted by the Feds. BTW, the Federal prosecution started while the elder Bush was President.
Soros DAs after the fact.
The question is will there be federal charges and if not federal charges do these officers get their jobs back?
The reason for the good news — Stacy Abrams is in trouble.
Will it burn today after this reaches the news? The old no Justice no peace fiery but most peaceful protest tactics worked for them in 2020.
They misspelled "rioters".
Again.
Many (most? all?) of the problems and social pathologies in the "black community" are self inflicted ...
Cue the riots... Atlanta burning would be a good thing.
