Vice President Kamala Harris says that congress needs to act and pass a law guaranteeing abortion rights to American women.

Didn’t the Supreme Court just rule that it is none of the Federal Government’s business? Any law they would pass would be un- constitutional.

But that point is moot since the Democrats will not be in any position to pass such a law in the near future.

So what we have have here is nothing more then empty promises to the sheep that vote for Democrats.

If Congress passed a law codifying the principles of Roe, it would be challenged in court. Whether it would be ruled unconstitutional is an open question. A federal law saying that the people are be free to exercise their right to secure abortions as ‘health care’ at will and not be restrained by any state, would start with four votes in approval. If arguments swayed one more, like Roberts eg, then Roe would be the legislated law.

I don’t see such a law being passed through the Senate, but I don’t think it is out of the question given the right electoral outcome.

I believe they only said that the right to abortion is not in the Constitution. The Congress will have to pass legislation in order to make it the law of the land since the USSC ruled this right is nowhere in our founding documents.
That still leaves the normal legislative obstacles in place including the filibuster and the need to have a supermajority in Congress for legislation this divisive.
