Will we ever know the identity of the Supreme Court leaker?

There are reasons to fear that the public will kept in the dark forever.

There is growing concern that we may never learn the identity of the person who for the first time in history leaked a draft of a pending decision. It’s been nine and a half weeks since the draft opinion on Dobbs v. Jackson Women’s Health was published by Politico on May 2. Although this is the biggest breach in Supreme Court security in history, we have had no indication that the culprit has been identified. This is strange, given the very small pool – fewer than 100 clerks, justices and support staff -- of suspects who could have had access to the very secret draft opinion, one that turned out to be very close to the decision finally handed down by the Court.

The agency in charge of Supreme Court leak investigation is the Supreme Court Marshals, which is not an investigative agency, but which provides security for the justices while in Washington, DC, and handles many administrative functions for the Court, including contracts administration, printing documents, paying salaries, and compensating expenses for maintaining buildings and grounds. The total number of staff is 260, including the small Supreme Court Police force that provides security at the Supreme Court Building. It is headed by Col. Gail Curley, a career Army lawyer who has held the title of US Attorney.

Given the magnitude of the breach of Court security, threatening the future integrity of its functioning if leaks become commonplace, it is hard to understand why nothing has been revealed yet to the public about apprehending the miscreant or miscreants. Polygraph tests should have been administered to all who had access to the draft document, the phone records of those with signs of concern should have been subpoenaed,

Sotomayer and one of her interns most likely. With the dems controlling all federal law enforcement branches of the government; they don’t want this info released. It would mean she would have to step down and right now she’s a good loyal Marxist activist judge on the bench for the Supreme Court.

They likely knew who the leakers were within a day. Maybe hours.

Roberts is hoping this story will quietly go away. The problem is that if they reveal the leader, there has to some sort of punishment, and Roberts doesn’t know how to do that. That’s why I think the leaaker was a sitting Associate Justice. Sotomayor is my guess.

The Federal Government identified the January 6 Peaceful Protesters with blitzkrieg efficiency and lightening speed! But finding the leaker??? No no no no no.

And somehow they couldn't find the RNC and DNC pipe bomber, even though he was all over videotape.

The easy way to find out is for the SCOTUS Marshal to ask every possible suspect to sign an affidavit under penalties of perjury...

Someone needs to get a list of all staffers, then compare that to the new list. See who left and what jobs they received.

The one with the most lucrative position is the leaker....like they suddenly work for Perkins Coie, the DOJ or the DNC.....

The leaker was a Democrat. Everybody knows, that you don’t snitch (to force a Supreme Court Justice to change their mind) on your own people (and get caught). So, we will probably never know!

If it were a staffer he or she would be known and fired immediately. Oscams Razor logic says it was one of the justices.

I think that the reason we haven’t learned the identity of the leaker is that it is one of the Justices. Certainly the Wise Latina comes to mind or her side-kick Kagan. As much as it hurts, I think that Roberts is right not to identify the leaker if this is the case. The Conservative 4 have much too much respect for the institution to be the leakers. I’m surprised that Roberts didn’t insist on some blood in return for his silence. Maybe the offending Justice loses a couple of clerks for their office. Sort of like the Patriots losing a couple of draft picks for Deflategate. lol

If it happens again, I suspect that the leaker will be identified by name and there be some kind of internal administrative censure. Not that it matters.

CJ Roberts is not my first choice but he is definitely on the list.

It is not good if they don’t find and/or release info on the culpable parties involved. Without that, the distrust at SCOTUS will not be resolved and will grow based on the import of the cases being heard.
