https://www.wklaw.com/california-dui-causing-injury-penalties/

A first conviction for a DUI causing injury is considered a “wobbler” offense. This means that the prosecutor has discretion to charge the DUI causing injury as a misdemeanor or felony depending on the circumstances of your case and your prior criminal history.

Blood test two hours after the arrest. When I was picked up, by two hours after the arrest, I was in a holding cell with no belt, no tie, no shoe laces, and dark blue fingertips.

35 years ago, for those scoring at home...

Or depending on your political connections.

How long did the sample sit before they tested it?

Since that test was administered a couple hours after the fact, I can see where that blood alcohol content was somewhat diminished.

BAL *after* 2 hours, that means at least 2 ounces of alcohol had been processed of the blood. Which means that his level at the time he was in the “accident” was double that.

That is also assuming we are being told the truth about it being 2 hours. I’ll wager it was double that in an attempt to get the reading below the legal limit. I’ll also wager that he was three sheets to the wind and that’s why they delayed the blood draw 4 hours and not the claimed 2.

He probably was also making sure they knew who his wife is and was trying to intimidate. It’s only logical with these people.

The alcoholics I know could put away crazy amounts.
They’re in recovery now.

That’s incorrect. BAC drops by .016 per hour.
Look it up.

"Obie, I can understand you wanting my wallet so I don't have any money to spend in the cell, but what do you want my belt for?"

And he said, "Kid, we don't want any hangings."

I said, "Obie, did you think I was going to hang myself for littering?"
