Nothing in this bill establishes a national red flag law. It just provides money for the States that choose to enact them.
The States don’t have to pass anything.

Do tell in specific legal terms with precedence and case law how offering funding to states who have a tenth amendment right to regulate firearms sales and possession as routinely held up by the Supreme Court is in violation of the U.S. Constitution which by letter of law only applies to the Federal government again as specified by the tenth. I would love to see a legitimate argument that has case law in it’s favored. There is a reason the states are sovereign federalism was designed to have now fifty independent states. Don’t like California laws move it’s that simple. Texas or Oklahoma will have vastly different laws. The constitution lays out what the Federal government cannot do it in now way limits the states.
I thought the funds were going only to the 19 states with Red Flag Laws in affect? Is this pushing funds to all 50 states whether they have RFLs or not?

What specifically do you think is unconstitutional? There is no national red flag law, despite the wording in the tweet. Just grants to states that want to implement them.
This whole thing is a big nothing. If you live in a free state, nothing changes. If this deflects from real gun control, it is a small tactical win.
Trust me, progressives will be creaming the loudest. This gives them nothing.

Caniglia v. Strom’s 9-0 decision has the potential to create lasting effects and set precedent as powerful as was DC v. Heller in 2008.
For the first time in 13 years, the Court upheld both privacy and gun rights, this time unanimously.
If Caniglia v. Strom teaches us anything, it is that the government cannot justify itself around the Fourth Amendment to invade private residences based on fear or gut feeling.
