Environmental group calls for deflating tires of SUVs to combat climate change: target ‘wealthy areas’

A radical environmental group raised a few eyebrows on Twitter after encouraging people to let the tires out of SUVs in an apparent bid to combat climate change.

The group, Adbusters, tweeted step-by-step instructions for the provocation on Wednesday, calling it a "gentle escalation" or ramping up the urgency about climate change.

"Wedge gravel in the tire valves, leaflet the SUV to let them know the tires are flat and why it was done, and walk away. It’s that simple," the group tweeted. "If we organize, we can hit enough SUVs in particular neighborhoods to spark reporting and spread the metameme."

Many of those caught doing this will no longer be using up oxygen, so that should help with climate change.

The definition of the crime:

Texas penal code Sec. 28.03. CRIMINAL MISCHIEF. (a) A person commits an offense if, without the effective consent of the owner:

(1) he intentionally or knowingly damages or destroys the tangible property of the owner;

(2) he intentionally or knowingly tampers with the tangible property of the owner and causes pecuniary loss or substantial inconvenience to the owner or a third person;

To wit:

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41; and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means; or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

The problem with that is if the tires have been flat for a while, the weight of the vehicle plus the wheel rims could actually sever the belts, making driving the car a really risky proposition (Joe Pags).

Willfully damaging someone’s property is criminal mischief in Texas. Doing that after dark in Texas is enough to get you killed. Force is authorised at all times to protect or defend tangible and or movable property in Texas which is defined farther up in the statute vehicles are in it my name no.ambiguity in the law there they are both tangible and movable property. Deadly force is specifically authorised after dark provided you are already authorised to use force in Sec. 9.41

Sec. 9.41. PROTECTION OF ONE’S OWN PROPERTY. (a) A person in lawful possession of land or tangible, movable property is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to prevent or terminate the other’s trespass on the land or unlawful interference with the property.

(b) A person unlawfully dispossessed of land or tangible, movable property by another is justified in using force against the other when and to the degree the actor reasonably believes the force is immediately necessary to reenter the land or recover the property if the actor uses the force immediately or in fresh pursuit after the dispossession and:

(1) the actor reasonably believes the other had no claim of right when he dispossessed the actor; or

(2) the other accomplished the dispossession by using force, threat, or fraud against the actor.

Having a tire completely deflated can damage the alloy too as they were never designed to have the full weight of the vehicle on the edges of them this can bend them out of round. In addition the tire itself can come off the sealing bead making it impossible to inflate again until lifted or towed to a shop to reseat that sealing bead. Plus the actual damages to the sidewall cords of the tire itself. Any one of these is a pecuniary loss and most certainly a substantial inconvenience to the owner. Both of which in Texas satisfy to the letter of the law criminal u. Do that after dark and things can go bad quickly with little civil recourse as Texas Castle doctrine in a separate statue indemnifies a citizen against civil action when they lawfully use the defence of property to include your home, business or vehicle by name in that statute.
