Kansas stand your ground law cited in lack of charges in teen's death

Lofton was experiencing a mental health crisis and was taken by police to seek treatment. Lofton’s foster family said that he had recently been paranoid and sometimes hallucinated.

Lofton resisted police officers, assaulting one, before being taken to the Sedgwick County Juvenile Intake and Assessment Center.

Lofton was told by an intake specialist that he would be released but was then put back into the cell by a security officer. Lofton hit the intake specialist while resisting security.

Bennett found that staff put Lofton on his stomach handcuffed and shackled by his ankles. Staff realized he was dead and called the police shortly after.

Bennett claimed that the case brought up legitimate policy questions, such as whether Lofton should have been taken to a mental health facility and whether the use of restraint was justifiable, but that criminal charges were not in order under current Kansas law.

What, if a crazy man goes nuts in a hospital, the facility must be evacuated so there’s no accusation of acting under the hated “stand your ground” principle?

They “went there” because self-defense laws are not resulting in the prophesied River of Blood, and they took anything they could to stretch out some negative press. And because they are idiots. But, I repeat myself.

So if he’s high and beating up on staff just what the hell are they supposed to do?

That has got to be one of the most confusing stories I have read today.

Foster kid was having a freak out.

Foster parents called police.

Foster kid fought with police (justifying their being called)

Police take foster kid to kooky people lock up.

Where foster kid is restrained and left on his stomach. (this is where it went wrong.)

What does any of this have to do with stand your ground?

Many minors in foster care have serious mental health issues that can cause violent behaviour. Mental health crises in such youths is very, very real; prescription medications administered for such disorders may bring its own bag of troubles, especially if the patient is newly diagnosed.

N.B.: Dr. Sivana is NOT a medical doctor, but a fictitious comic book doctor of the mad scientist variety.

If the guy is on his stomach handcuffed and shackled by his ankles, don't sit on his back for thirty minutes and suffocate him to death.

Yep.

That was what we were taught. If you must restrain someone put them on their side.

BTW, this was apparently a Covid-19 death and no I am not joking.
