The Guard should be under state control unless activated by Congress. As it is now, the president can play with the Guard whenever he feels like it.

The National Guard is under state control and doesn't go anywhere without the governor's approval. The Virginia governor, Racist Ralph "Blackface" Northam, signed off on this deployment.

Interesting. I thought that the president can federalize the Guard, and then send it anywhere he wanted. The states are a check against federal power. So If I’m wrong about the Guard here, I’m happy that I’m wrong.

This opinion is not in line with the SCOTUS decision of Perich vs Department of Defense.

Perpich v. Department of Defense, 496 U.S. 334 (1990), was a case decided by the United States Supreme Court concerning the Militia Clauses of Article I, Section 8, of the United States Constitution, in which the court held that Congress may authorize members of the National Guard to be ordered to active federal duty for purposes of training outside the United States without either the consent of the governor of the affected state or the declaration of a national emergency. The plaintiff was Rudy Perpich, governor of Minnesota at the time.

This is a further reason for states to maintain a viable state military force outside of direct federal control. The Army and Air Force National Guards are reserve components of the US Army and Air Force. Remember, the National Guard did not exist before 1903.
