A Lubbock, Texas, man was shot and killed while arguing with his ex-wife over their child custody arrangement, and it was all caught on cell phone video.
The incident unfolded on Nov. 5, according to attorney Matthew L. Harris, who is representing the victim's widow. Harris says the footage was filmed by Jennifer Read.

If I were the prosecutor, I’d look closely at the possibility that she planned it.
And if I found sufficient evidence, I’d prosecute the highest charge, and seek the maximum penalty on any conviction.
The maximum penalty appears to be death for murder for hire.
Aside from the armed variety of Peewee Hermans my best buddy is 5’6 140 and is the toughest meanest guy I know. He was an easy target in school and over compensated. Holy crap did he compensate. His last fight was a dozen years ago with 2 drunk guys. It lasted less than 1 second. Statute of limitations might not be quite expired on that one.
Guys goes in to get a gun, he actually escalates the situation, when you provoke the situation, going in to get a gun, even though you have not been threatened physically, much less physically assaulted...the only threat is to be sued, only to be sued, you lose your self defense case.
2nd degree murder. Easy call.
Assuming it is the shooters property- in Texas a jury could go either way in a case like this (regardless of what the law says Texans and especially those in West Texas really believe in Property rights). I wouldn’t be surprised by a hung jury. I don’t think the DA will even try for anything more than manslaughter (unless he tries to use a murder charge to plea down to manslaughter). However I would never bet money (or my life) on what a DA will or won’t do.
Interestingly if the shooter had waited a second or two, the shooter may have starred to advance toward him and he would have a much easier time justifying self defense.
The smart choice would be to have the mom go in the house, set up just inside the front door and wait for the cops. Then if the dad even tried to get in- obvious self defense.
As for this being a set up- don’t know - but it will be looked into. There was an incident in my neck of the woods a few years back. It wasn’t a set up, but the police gathered phones and records to see if an ex was “invited” to a current boyfriend’s house.
If it was a setup the dad played right into it.
I would expect the shooter will go free and that the local DA won’t try too hard or spend much time on this case...since it is Lubbock, afterall.(according to reputation anyway).
lesson to be learned....just because you have a gun, doesn't mean you should be grabbing and using it....one moment you think you're just showing strength and the next moment you've shot someone.
Well, I was taught that if a home owner, pulls out a gun, orders you off of his property, AND fires a warning shot .... it is PAST time to leave.
Hmmmm? That could have been her plan but, it would be hard to prove she wanted him killed. Instead She planned on the 2 confronting each other so she could get her jollys. What’s the charge for setting 2 people up for a confrontation? Volentary or involuntary Manslaughter?
No charges appropriate, says a Special Grand Jury of their peers. Legitimate self defense. Justice is served, just as I said at the time.
YAY - You win, you were right, Now, the mans life is worth less than a week old pile of dried chihuahua poop. but his name has been cleared.
Whole lot of assumptions there. And an important legal precedent has been reaffirmed. Self-defense is a RIGHT.
