Jury awards $10 million to South Carolina woman who stepped on rusty nail at Walmart

A jury has awarded $10 million to a South Carolina woman who sued Walmart after she needed multiple surgeries because of an infection that resulted from stepping on a rusty nail inside one of the company’s stores in Florence, her lawyers said.

“The weakness of Walmart’s case, among other things, was their failure to produce a video that they claim showed their conforming behavior to a company policy calling for employees to perform regular safety sweeps,” the news release said. “No such evidence was presented for the duration of the five-day-long trial.”

It was pure negligence on the part of the Wal Mart store. They admitted they didn’t follow policy about keeping the store clean and free of possible safety issues. They admitted that it was the nail that caused the injury and resulting medical issues. They screwed up start to finish and they’re paying the price for it.

Ok, so WalMart should owe her $50 for a tetanus shot and a band-aid. If she somehow had to have her leg amputated from stepping on a nail, sounds like she should be suing her doctor/hospital, not Wally World!

Never occurred to me to sue Kroger.

If it ultimately led to the amputation of your leg would you still have not sued?


If that was the case, I would have sued my doctor or the hospital... The amputation was the result of poor (or nonexistant - did she even go see a doc after it happened?) medical care, NOT directly from her stepping on a nail.
