My (extremely liberal) company in New Jersey has issued a mandate based on Biden’s “vaccine” mandate for companies who are also federal contractors.
The originally deadline was October, but kept getting kicked down the road with delays, and court stays. Now it seems like the Jan 5th deadline is it. If my “vax” card is not loaded into their confidential system by the 4th, I will be terminated with no severance on Jan 5th, after 7+ years of impeccable service and dedication. However there’s more to just not wanting to get the shot. I was approved to move out of state (to a popular state in the south with a great gov), which I uprooted my life and moved to earlier this month, so I will be working remotely, however they are mandating it for remote employees as well.
Here’s the real kicker… I applied for a religious exemption in the late summer and was APPROVED. BUT NOW, HR has said in black and white that my religious exemption is not longer approved… that they can “assume”, but not “determine” that I have strongly held religious beliefs... that is their basis for denial. And that working remotely or getting tested would create “an undue hardship” with my company.
Anyone else getting this same BS from their job? What course of action are you taking? I am NOT going to get this shot, so I am weighing all of my options, including submitting a discrimination complaint with the EEOC, and outing the company to local news sources.
Maybe tell the company that if the mandate becomes official, only then it is valid.
Also, maybe offer your services as an independent contractor and negotiate the terms.
I don't like dishonesty, either.
However, this is leftist overreach and injustice on parade, and anytime I can stick it to those a**holes, I relish the opportunity.
After all, the left aren’t exactly beacons of honesty, right?
And if they discover your deception, what are they going to do…fire you?
Then you’re no worse off.
I’m pretty sure you will need to apply for UI from New Jersey. UI is based on earnings for the past 12 months. When I lived in NY and became unemployed in NJ I received NJ Unemployment. The good news is the NJ UI is one of the highest in the country. If you max out I think it’s close to $600 a week.
Watch FLASHPOINT episode 11/18/21 with Sam Sobo, Rick Green and Liberty First’s lawyer!!! She has the Navy Seals anti-vax case.
It’s VERY informative and we must arise and fight this.
Maybe just give them ten years of your tax returns and show you have tithed/given to churches...!!!!
Don’t give in, and don’t quit.
Make sure they fire you for not getting the shot... nothing else.
No job is worth dying for.
Quitting gives you no legal recourse.
And there are NO EXEMPTIONS for an illegal mandate.
The “undue hardship” needs to be challenged in court. How? If they have to make ‘reasonable accommodations’ for disabled people then this doesn’t pass a smell test.
I have a son facing the same problem. He is going to leave. His religious exemption was denied.
IMHO...this is nothing more than threatening somebody (with their job) to receive something of value in return - and there’s another, dictionary definition, word for this...it is called EXTORTION. I am waiting for somebody to sue their employer for EXTORTION.
They may be a private company but that doesn’t mean they can do anything they want or break the law. Pfizer now has pills to treat COVID. OSHA is backing off from the mandate. There is no requirement to do this and given the data that comes out almost daily, these ‘vaccines’ aren’t the silver bullet as claimed.
Somebody needs to put together a law suit that includes the comprehensive data available showing that lockdowns, the jab, masks, etc. are not working and this is an unreasonable requirement of an employer that has moved into the arena of EXTORTION.
MAKE THEM SQUIRM. Corporations don’t like sticky lawsuits. You may get paid to go away at least.
Fired as of EOD Monday, 11/29. I’ll be dancing out the door. It was time for a change personally, and I suspect this woke-ass Fortune 4 company will be taking a hard hit soon anyway.
Understand, thanks for the explanation. We will agree to disagree.
This would lose in an EEOC lawsuit because it flagrantly violates the letter of the law. They're not going to sacrifice the Civil Rights Act of 1964 over this. This is just them desperately trying to get as many people vaccinated as possible.
Change your gender identity, trick them in to misgendering you, and she their asses. We have to play their games with their rules. Show up in a dress or trousers depending on your new identity. Do everything in your power to destroy them. Hurt them. Make them pay.
I Won’t Back Down
Bump!
“HR has said in black and white that my religious exemption is not longer approved… that they can “assume”, but not “determine” that I have strongly held religious beliefs.”
I would take this opportunity to invite their HR personnel to attend any and all religious services you attend - and provide a schedule and map. And it would be very easy to hint that their failure to either re-approve your religious exemption or attend with you, that they are NOT doing a good faith investigation to ascertain that you DO have strongly held religious beliefs.
Your company is run by real scumbags. Do you really want to work for a company like that? There are a lot of companies looking for good people right now.
I’m not sure how that goes. My company is based in a purple state up north, but it has a branch in the popular state, so would that branch not be subject to the laws the governor just enacted?
Likewise, since you are in the popular state, wouldn’t you be exempted since you’re representing the company within that state? That is, you are effectively your own branch of the company in that popular state.
My recommendation ... don’t retire ... make them fire you. That’s my plan.
They and others are implementing a so-called mandate that is not in force... very likely will not survive judicial scrutiny. Makes me wonder if this is a convenient excuse to shed employees in the current economy.
Now I have a question for this wonderful group. My manager is bugging me to get a religious waiver. She is having HR contact me to “explain” the waivers to me. Thing is, as I posted previously, I do not want to go after a waiver as I feel it is none of their business what my beliefs are. I will not comply with anything surrounding this mandate. I just feel there is something behind all of this in pushing me. Is there something nefarious here in them trying to cover their butts?
