‘Rust’ Production Company To Launch Internal Safety Review After Fatal Accident, Possible Prior Gun Incident & Camera Crew Walkout

The New Mexico set of the indie Western Rust, where cinematographer Halyna Hutchins was shot and killed Thursday by a prop gun “discharged” by star Alec Baldwin, had been having a myriad of issues, including problems related to safety, before the accident, according to multiple sources with direct knowledge of the situation. That included at least one previous incident involving a misfiring of a weapon that was used days before in a scene.

“A gun had two misfires in a closed cabin,” a source told Deadline. “They just fired loud pops – a person was just holding it in their hands and it went off.”

Even before Rust went into production, a number of armorers turned down the gig citing concerns about the budget of the film and the sheer amount of firearms to be utilized, we hear.

Safety protocols had to have been lax on this set.

A live bullet winding up in the gun is one thing, having folks standing in the path of a gun being fired (even with it thought to be a blank) violates even the most basic safety protocols.

I can’t imagine they allow an actor to fire a gun pointing at a person and fire which clearly happened here, or let them stand in the possible path when they know the gun will be fired...

Can’t imagine they wont find some serious violations, completely unrelated to what lead to a live bullet being in the gun, when all is said and done.

Alec Baldwin had some very harsh words for Dick Cheney after the Harry Whittington incident.

Then there is a tweet from four years ago where Baldwin says he wonders what it is like to wrongfully kill somebody.

Since it was non-Union labor as prop masters, I wonder if some pro-Union person might have slipped a real cartridge into the prop gun.

Blind Gossip] We have some shocking inside information about what was really going on behind the scenes of a troubled movie that is currently in production.

The crew actually staged a walk out before this happened.

The crew walked out? Why?

The crew had very serious concerns about safety from the first day of production. The cast was also worried.

It was obvious that the “expert” who was hired did not know what the hell they were doing when it came to handling weapons and it scared both the cast and crew.

The crew was afraid that someone was going to get hurt. That’s why they walked out.

So the producers knew there was a problem?

Absolutely. They knew there was a very serious problem and they knew why the crew walked out.

Wow.

So this accident did not happen out of the blue.

The safety issues on this movie were known to cast, crew and producers from the very beginning.

The crew was concerned enough to walk out.

Clearly, the problem was not fixed.

Given all this, the production company and the individual producers – which include the lead actor – may ultimately be responsible for the tragic consequences of their actions.

“Citing a source close to Local 44, the Los Angeles Times reported that the union is unaware of what projectile was in the gun fired by Baldwin. The source pointed out that “live” is an industry term that refers to a gun loaded with material, such as a blank, in preparation for filming.

Local 44 did not return IndieWire’s request for comment.”

It’s a wobbler. I’d charge second degree murder based on the fact that he apparently pointed a loaded weapon at a person and pulled the trigger. Any normal person with any gun safety training knows that you NEVER point a gun at any person unless you intend to kill them.

The fact that he thought it was loaded with blanks would be a possible defense, but he’d have to take the stand and testify as to his mental state at the time of the shooting. By charging him with second degree murder, you force him to plead out to the lesser charge or take the stand.
