I wonder how the state unemployment office handles that. She isn’t terminated. She didn’t quit. Does she fall through the cracks and get no benefit?

I would imagine that the hospital will take one of two routes in this. Since vaccination was a requirement of employment and she refused to get it then they might say she voluntarily ended her employment. In which case, no unemployment benefits. Or they might say that she refused to comply with the instructions of her supervisors and was therefore fired for cause. In which case no unemployment benefits.

Seems to me that she can claim and collect as it will no doubt end up as a permanent lay off.
