Hochul announces deal to renew N.Y. eviction freeze, secure more rental relief: ‘We have to take this action’

Gov. Hochul announced late Tuesday that she’s summoning legislators for a rare special session to extend New York’s expiring eviction moratorium and allocate more financial relief for renters in a bid to stave off an avalanche of evictions at a time when the coronavirus is resurging in the state.

The special session, set for noon Wednesday in both the state Senate and Assembly, will feature two legislative items to counteract the feared “eviction crisis,” Hochul said from the Capitol in Albany.

First, Hochul said she has reached a deal with Democratic leaders to renew the eviction moratorium — which was set to expire at midnight Tuesday — through Jan. 15, 2022, protecting hundreds of thousands of struggling renters from the possibility of being kicked out of their homes.

No surprise here. They get rid of one Marxist as Governor and replace him with another. Absolutely zero reason for this after two years of multiple stimulus checks and fat inflated unemployment checks not to mention jobs everywhere. I live in NY and saw McDonalds was so desperate for people they were starting at $20 an hour.

When does the property owner get some relief?
I have heard of several property owners now made homeless, now living from cars, due to renters who refuse to pay or move out. Too many of those who do finally move out, do so after an expensive and destructive tantrum.

It has to be, this is basically forcing a business owner to give away their product for free for YEARS. What right does the government have to do that? And what gets me is they still demand these landlords pay property taxes and heating bills not to mention maintenance costs of which they are massively fined if it is not done. Look at this woman, she’s a landlord and she’s now HOMELESS!!

That’s exactly what this is all about, what it is REALLY about. They want people to get use to living like bums, living off the taxpayer dime so when election time rolls around they vote commie rat every time. This crap really ticks me off because there are jobs all over the place, help wanted signs everywhere solely because of the government paying people not to work.

The rental assistance money can’t be had by the landlord unless the tenant cooperates and can prove they lost income. However the tenants know they can just do nothing and stay in place. The landlord can’t prove anything. The landlord can’t even know or prove the income of the tenant. The whole rental assistance thing is just a trick to make it look like the government is paying the landlords. The truth is that most landlords can’t get the money because of the tenant.

So the landlord has to pay a lawyer maybe $1000 to get in court and somehow prove the tenant’s income has been reduced due to covid. How exactly does that work? And the tenant will just cry that covid killed there income and the judge will then throw out the eviction. There goes $1000 dollars down the drain for a tenant who is not paying the rent. The lawyers no longer even want to touch evictions because they can’t win.

These liberal politicians are pure evil scum.

It’s awful. I’d always wanted to invest in real estate, but now it appears it’s impossible to actually own rental properties. The government decides who gets to live in your property – not you.

What should be done, (I haven’t fleshed this all the way out so your thoughts are welcome), is there should not be a moratorium on evictions. Instead the law should say that the eviction case may continue and the hearing judge would require the tenant to provide his evidence that he/she could not pay the rent.

That would include pay stubs, bank account statements, savings and investment accounts, etc. The judge would then make a ruling on whether the tenant was able to pay all of the monthly rent payments or a portion of the payments due based on the facts presented.

Once the decision is made that the tenant could not make the payment the court would order the tenant to apply for the rental assistance.

Alternatively the state could place a certain amount of funds in an escrow type account and allow the judge to order the past due rent to be paid to the landlord from this account with the tenant being responsible to repay the state over a 3-5 year period, (it’s a loan, not a gift).

If the judge determines that the tenant could/should have been making timely rental payments but did not for unreasonable reasons then the judge can order the eviction immediately and order payment of the delinquent amount of rent or award the past due rent to be paid from the above fund with the tenant being obligated to repay the state, (treated like a fine).

Like I said, it has not been fleshed out but it would be workable.
