The only problem with your line of thinking is that the EUA has nothing to do with the legal immunity. The legal immunity for vaccine producers extends to ALL vaccines, regardless of whether they are covered under a standard FDA license or an EUA.

The legal immunity has a sound rationale behind it. The whole purpose of it is to protect the manufacturer of a vaccine with serious side effects for 1% of the users when the vaccine protects a large population against a disease that has a 50% fatality rate. You don't want that pharmaceutical company keeping the product off the market out of fear of its legal exposure for the 1%.

That’s in quotes, it’s not my thinking. I do think he’s right. It looks like the FDA deliberately put the covid vaccines in CICP instead of VICP for liability reasons.
