And, yes, it is Constitutional. States have the authority to regulate public health and they have in the past mandated vaccines. The classic case in this area of law, Jacobson v. Massachusetts in 1905, was decided by the Supreme Court after a smallpox outbreak.

It’s only constitutional if it’s an FDA approved vaccine. This is not. It’s available under the Emergency Use Authorization and for that reason nobody can be forced to take it against their will.
