A Vineland man has sued an employee and manager of a local Dunkin’ Donuts after he says he was burned by a cup of coffee that spilled on his lap last year while he was going through the restaurant’s drive-thru, according to the suit filed earlier this year.
The man, Leonard Allen, is also suing Dunkin’ Donuts Inc., in addition to the manager and employee of the Vineland coffee shop located at 709 E. Chestnut Ave.
The incident happened on Aug. 25 when an unnamed female employee “without any due caution” served him a “scalding hot” medium coffee “in a manner as to spill the entirety of the liquid on Plaintiff’s lap and causing immediate and agonizing pain to Plaintiff’s thigh and groin area,” according to the suit, which was filed in Cumberland County Superior Court on Feb. 18.
The suit claims the employee acted in a “negligent and careless manner as she failed to properly secure the cup and lid of the beverage.”
Allen suffered second degree burns to his “persons and other personal injuries of both temporary and permanent nature,” the suit claims. As a result, he will “be compelled to expend large sums of money for physicians and medical treatment in an attempt to cure himself of said injuries and has been prevented from attending to his normal business and affairs, and has suffered various other economic and noneconomic damages,” it claims.
The suit asks for compensation to “reasonably and properly compensate” Allen, including interest and court costs.
A spokeswoman for Dunkin’ Donuts said the company had no comment as the outcome of the suit was still pending.
They wouldn’t buy the coffee unless it was that hot.

“last year” hummm... I guess he needed five months of in home Keurig testing to make sure he didn’t roast his nuts before setting up his scam.
They need to try this at Starbucks. They need the advertisement.
Any footage from the store ? I would think the drive through window would have a camera aimed at it.

Well I’d need to know the details. If the employee didn’t secure the lid properly and spilled it on him then it is their fault.
If the guy dropped it in his lap it’s his fault. If I go to a gun range and the range master lets people run in a shoot ganster style and rolling all over the place behind my back...and they shoot me in the leg. I’d sue the gun range.
I don’t know what to make of this without first knowing the company policy on blm. If they are pro or funders, I’m okay with a hefty award to the aggrieved party, regardless of his race, however he identifies.
The issue isn’t that the coffee is hot...it’s that the cup wasn’t secured properly and served to him in a safe manner.

The last time it happened ( MacDonald’s ), the victim, a woman, was awarded nearly $3 million by the jury in her lawsuit. That was in 1994.
