It was proposed that 11.3 was a reference to section 11.11.3 in the DOD Law of War Manual. The section is entitled “Properly Constituted, Non-Political Military Courts in Occupied Territory”.
The Manual is readable online and the page for this section is 764. I’m not sure how relevant it is, except that the US may now be considered an Occupied Territory.
