So if Trump invokes the Insurrection Act on Monday and the Courts strike it down on Tuesday, then what?
Ask me on Tuesday if that happens...The Dems may well run to Judge Sullivan in DC. Trump's SCOTUS appointees have all be strong proponents of executive power, so he should prevail there. If CJ Roberts is the first guy on the plane to Gitmo, then it won't matter.

Ask me on Tuesday if that happens... You know it will. The condition that allows the Insurrection act to be invoked is that conditions "make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings..." That is not the circumstances currently. Courts are operating openly and freely in all parts of the country.
If CJ Roberts is the first guy on the plane to Gitmo, then it won't matter.
And what part of the Insurrection Act gives the President the power to do that?
