Rep. Thomas Massie: Congress has no authority to influence outcome of 2020 election

"The text of the Constitution is clear. States select electors. Congress does not. Accordingly, our path forward is also clear. We mush respect the states' authority here," the statement said. "Though doing so may frustrate or immediate political objectives, we have sworn an oath to promote the Constitution above our policy goals."

The seven Republicans began their statement by expressing outrage at the "significant abuses in our election system" through "reckless" adoption of mail-in ballots leading up to the November election.

Trump and several other congressional leaders have complained of voter fraud tied to the widespread use of mail-in ballots during the pandemic, though no evidence supports claims of a rigged election.

"The people cannot trust a system that refuses to guarantee that only legal votes are cast to select its leaders," the representatives wrote. "The elections held in at least six battleground states raise profound questions, and it is a legal, constitutional, and moral imperative that they be answered."

However, they continued, "only the states have authority to appoint electors, in accordance with state law. Congress has only a narrow role in the presidential election process."

The legislative body's role is to count the electors submitted by states, not to determine which electors should have been sent, the representatives said.

Massie, along with Kelly Armstrong, R-N.D.; Ken Buck, R-Colo.; Mike Gallagher, R-Wis.; Nancy Mace, R-S.C.; Tom McClintock, R-Cal.; and Chip Roy, R-Texas, said Congress will have no authority to influence the outcome of the election unless a state decides to send a new slate of votes to Congress before Wednesday.

"To take action otherwise — that is, to unconstitutionally insert Congress into the center of the presidential election process — would amount to stealing power from the people and the states. It would, in effect, replace the electoral college with Congress, and in doing so strengthen the efforts of those on the left who are determined to eliminate it or render it irrelevant."

The votes that came in for Biden after counting ceased should be null and void.
Also any votes switched from Trump to Biden should be switched BACK TO TRUMP.
TRUMP WON.That’s why they shut down count.

Wrong. The biggest election infraction is that the election rules, election procedures, electors and elector ballots in all of the disputed states were unconstitutionally provided with no input from state legislators.

I don’t disagree with you about fraud or CCP bribes but they would say they’re following the constitution and that gives them a limited role as Members of Congress...

Yes, he’s right in terms of directly voting to overturn a proper and valid certification.

But there is nothing wrong with Congress objecting to an improperly made or fraudulent SoS certification which bypassed state legislature or which violated state constitution.

And if a state sends no valid certification or alternative certifications, Congress has a role in resolving it, per the Constitution.

From what I gather they’re saying the state legislatures should remedy it not Members of Congress and they do this by sending them Trump Electors by Wednesday.

Are the Objectors doing anything outside of the Constitution?

I think not. Protecting the rights of the objectors is protecting the Constitution.

The traitors only cite the Constitution when it helps their cause, the destruction of our Constitutional Republic.

huh? well you may understand but i certainly don’t.
i’m not a lawyer but imo, i’m calling nonsense, on these misguided reps and their ridiculous interpretation of the Constitution.

0. there’s a mountain of evidence of fraud and it keep’s growing. to certify Biden is to break moral, state, local, and federal laws enacted under the, wait for it, Constitution.

1. you can’t make an any kind of a true argument including a Constitutional one on a false premise.

2. the Founding Fathers didn’t frame or intend the Constitution as a passive suicide pact to be followed like a lemming blindly to the destruction of the Republic under any interpretation, and under originalism there is no way to construe it as such.

3. the Constitution is not intended to be self-executing as these folks are interpreting it, it’s limits must be, defined, enforced and followed by legal means and moral means by the entities it has created. it is an interpreted document. imo, there is no valid interpretation under the Constitution where you must do something immoral or illegal to follow it. period.

When I cast a vote for President of the United States, the last thing I want is some crooked @sshole from Congress to have any say in the matter.

And that cuts across party lines, by the way.

But who makes that determination? It’s the states that have to make that determination and inform the Members of Congress and/or send Trump electors.

It could be seen as an act of war, coordinated treason, or insurrection, and would therefore fall under the authority of the executive branch e.g. Trump.
