Pence is not on board with the Democrats except on this issue. No reasonable reading of the Constitution indicates that a vice president can simply discard or change electoral votes he doesn’t like for some reason.
I’m obviously in favor of anything that upholds President Trump’s rightful re-election landslide victory that is being stolen from him -
But, having said that... this claim that the VP can just singlehandedly decide the election - is just absurd.

There is no way the Constitution gives the VP the power to choose electors. If the VP had that power...

Why are we even talking about this?
This is the House Republicans, asking the courts to tell a Republican Vice President, how to make a decision regarding the legislature before the legislature acts. That violates separation of powers issue.
Also, look at it this way, the real issue is between the Democrats and Republicans in the house, not between the House Republicans and the Vice President. If you have a dispute with your neighbor, you and your spouse can't sue each other to get a ruling against your neighbor.
But like i said, I don't think it's in the cards.
I think the effort to force Pence to acknowledge that the Constitution DIRECTS he SHALL PRESIDE over the count of electoral votes, making him ALONE responsible for the PROPER conduct of the count... is one issue.
A more important issue might be... ensuring Pence is served with a proper notice... informing him, in a way that he cannot deny, that the “certified” electors are a product of an ongoing FRAUD. Because of that fraud being practiced: Pence should also be served with a request to see his communications with all of those who are being accused of conducting a fraud. The proper agency for making that demand, might well be the state Legislatures.
The purpose of the fraud being practiced is to either deceive or compel Pence into wrongly accepting the products of fraud in his performance of official duties. Simply exposing the FRAUD... not in public perception, but in recognition in official process... leaves him a choice of participating in the fraud, or refusing to participate in the fraud... as that is the real choice being made.
Legislatures... need to NAME the fraud, as a fraud... while taking action in addressing it... not only decertifying, and not only allowing the event in recalling those perpetrating the fraud... they should also initiate impeachment proceedings against those who are obstructing the process of proving the fraud.
Sounds like a valid constitutional question but the court does not like to rule on something that has not happened.

Always figured Pence to be an establishment poison pill. He’s been a decent Veep, but he’s always had that “I’ll bail in a heartbeat is the going gets tough” vibe.
He’s not onboard with the democrats, he’s following the constitution. He has no constitutional authority to decide if the electoral votes certified and sent by the states are valid or not.
Imagine if in 2016 Biden had else died that because of Russian interference in the election he was not counting the electoral votes for Trump and declared Hillary the winner. It would have been unconstitutional for him to do so and everyone on this website would have been screaming bloody murder.
The 12 amendment stipulates that all the votes will be opened and counted.

If Pence can save us from the Sniffer and the Commie, I’m for it. The Sniffer should have been out front proving he was the winner, instead of, letting his friends, the slimes, pick the winner.
