“What is the Impoundment Control Act?
The Congressional Budget and Impoundment Control Act of 1974 (ICA) reasserted Congress’ power of the purse. Specifically, Title X of the Act – “Impoundment Control” – established procedures to prevent the President and other government officials from unilaterally substituting their own funding decisions for those of the Congress. The Act also created the House and Senate Budget Committees and the Congressional Budget Office.”

“A 2018 Government Accountability Office legal opinion holds that if the President proposes a rescission, he or she must make the affected funds available to be prudently obligated before the funds expire, even if the 45-day clock is still running. This means, for example, that the President cannot strategically time a rescission request for late in the fiscal year and withhold the funding until it expires, thus achieving a rescission without Congressional approval”

It is likely he cant impound anything, because of this rule requiring funds be freed before january 3rd.

anything he can legally impound automatically un-impounds in 45 days unless congress passes a bill supporting recission.

Biden can undo the impoundment when he is sworn in on the 21st.

"Title X of the Act, also known as the Impoundment Control Act of 1974, specifies that the President may request that Congress rescind appropriated funds. If both the Senate and the House of Representatives have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation. Congress is not required to vote on the request, and has ignored most Presidential requests. " From Wikipedia.

-This sends it back to Congress forcing them to 1) repeal 230, 2) cut out the wasteful spending, 3) add $2k.

It doesn't force Congress to do anything; it invites them to. But the current Congress ends in 6 days.

In the past, Congress has simply ignored other Presidents citing the act.

Joke is on POTUS here.

I would like to know who talked him into this.

POTUS cannot fight Congress now if signed. They just take his signature and blow off the rest.

POTUS simply has no Constitutional mechanism to force Congress to do anything once he signs his me.

Whoever persuaded Trump to do this, is an enemy. But too late now.

I can’t breathe, I am laughing so much.

President Trump can with hold the monies till mid February.

There is prolly more than 1001 ways to frame/compose a message to Congress to request a Rescission of the funds.

That is more than enough time for Nancy and Chuck to cave and submit a new spending bill to open the Government.

The left has 40 days to wake up and understand Nancy, Chuck and AOC short changed them viv a vis the rest of the world.

A lot of people commenting should be spending your time in a remedial reading class. President Trump has not caved on anything. President Trump is fighting for the American people. This man has single handedly fought off every attack that has been launched at him since before he announced his first campaign. If you think he’s giving up now you are very wrong.
I want him in for his second term even more now. I’m anxious to see him unleashed and pissed off.

It does no such thing. If Congress doesn’t act within 45
legislative days y doing what Trump wants, he money must be released as in the original bill signed by the President. In other words, if Congress does nothing, the funding in the bill goes through, whether the President likes it or not.
