Judge delays sentencing for ex-FBI lawyer who pleaded guilty in Durham inquiry until after Biden inauguration

A judge delayed the sentencing of a former FBI lawyer ensnared in special counsel John Durham's criminal inquiry into the Russia investigation until after Inauguration Day.

Kevin Clinesmith, who pleaded guilty in August to falsifying a document related to the secret surveillance of 2016 Trump campaign aide Carter Page, now faces a sentencing date of Jan. 29, more than a week after President-elect Joe Biden is set to take office.

Durham, the top federal prosecutor in Connecticut, asked U.S. District Judge James Boasberg of the D.C. District to sentence Clinesmith to as many as six months in prison to "send a message that people like the defendant — an attorney in a position of trust who others relied upon — will face serious consequences if they commit crimes that result in material misstatements or omissions to a court.”

Clinesmith's lawyer requested probation and community service for his client, arguing a more lenient sentence would be a "just punishment," as the fired FBI lawyer's "reputation has been ruined, his professional career is in shambles, and he has been unable to support his family financially at a time when he and his wife are expecting their first child."

Biden has not yet said how he will treat Durham's inquiry, but Attorney General William Barr, who left the role this week, elevated the prosecutor to special counsel status in October, which provides extra protections and independence to complete his work.

Boasberg reset the sentencing date this week as he set a deadline for responses on Jan. 5. A coalition of victims rights groups filed a motion for relief last week in support of Page's motion for relief under the Crime Victims' Rights Act.

I can’t think of a single legitimate reason to delay sentencing in a criminal trial because of a presumed change in the presidency.

“Everyone needs to understand that the so called judges in our once great Republic are nothing more than activist morons. They are held unaccountable to no one.”

Congress can fix this situation tomorrow:
1) Congress can impeach and remove judges. They choose not to.
2) The Senate approves all federal judges before they take office.
3) Congress determines the jurisdiction of the federal courts below the Supreme Court. Congress can pass a law placing limits on the jurisdiction of the federal courts tomorrow if it wishes. It choose not to.

Plus the president can send a request to Congress to initiation impeachment proceedings against any federal judge or request Congress change the role of federal judges and the jurisdiction of the courts. It has not happened.

The Constitution provides the vehicle for addressing all of our ills. Unfortunately we the people continue to fill the Congress with men and women unwilling to do their jobs.

My question is and should be the question everyone should be asking themselves. Just how long are we to live under a corrupt government and a even more corrupt judicial system. We need to be doing something!

I wish I was a lot younger to begin activism in an opposite direction from where we are headed. The longer we, as Americans, allow this absolute corruption to continue the worse it is going to get. This election was only the first step and if it is allowed then expect a deeper stab into the heart of America. They the anti-American crowd that are running things now have only begun.

Boasberg is the chief judge of the FISA court. Clinesmith defrauded Boasberg's court. You would think the judge would call the Federal Marshalls and just throw Clinesmith in prison until it was all sorted out.

This guy’s lawyer walked him to Durham’s door - and he told Durham he wanted to plead guilty.

Durham was like - WHAT?

He showed up out of nowhere.

And he’s out and about, there has been no time served.

One day we may find out that Durham has mostly been used as the face of the project, but had little to do with the results or lack thereof. Similar to Mueller.

Have you ever wondered why Durham never gives any in person interviews or updates or live commentary of any kind?
I have. He’s riding on the strength of his career’s reputation. What has he done for us lately?

I struggle with the same concerns and questions you have. Inertia is a powerful force. People are still in the comfort zone. Major change has occurred over the past 70 years but the pace has generally been slow enough that people are disgruntled but accept it and then move on. What we are experiencing now is rapid change which is harder for people to absorb. There will be a backlash and when the backlash comes the state will either have to back off or crack down hard and violently.

Don’t be surprised if the DOJ under Biden, (if he is inaugurated), will file a motion to withdraw/dismiss the case claiming misconduct by Durham, (as a slap in the face of Flynn). He will never see a day in jail.
