The SCOTUS branch of your constitutional government just weighed in.

The Constitution is not the problem, the people placed in charge of enforcing it is the problem. That said, I will agree with you that the Constitution is largely moot at this point as a practical matter.

The typical case with looks good on paper.

The people are the ultimate power that, through the states, created the confederation and its replacement, the constitution.

The question now is whether the creator or the creation has the power.
