Lawsuit targets New York Life for rejecting job applicants with arrest records

A job applicant spurned by New York Life Insurance Company has filed a proposed class action lawsuit alleging that the company discriminated against applicants who had previously been arrested, even if no charges stemmed from the arrests.

Aliea Hughes-Phillips and her lawyers at Outten & Golden alleged in a Manhattan federal court complaint Thursday that even though she was qualified for a customer service position, her job offer was revoked due to arrests in 2010 and 2017. She said she was not charged after either arrest.

I would think that a criminal record would be a benefit to a life insurance agent. Every time I talk to one I feel like I'm on the wrong end of a game of three card monte. I especially love the ones who tell me I should take money out of my IRA to get the tax benefits of a complicated indexed life insurance policy.

Kind of makes sense. I’m not sure it’s fair to call just an arrest a “criminal record.” Innocent until proven guilty and all that.

Bet she lied on her application which asked if she had ever been arrested, and when they did a background check, the arrests came up.

We know how to fire leftards and SJW’s morons. Actually we perfected hiring only right-minded people and it all comes down to filtering thru the interview process. Just like the 2 faggots who went after the Christian bakery who was 50 miles outside these pukes area , and had at least 15 wedding cake - themed bakers—they still went outside the area for their intended target.

I agree. Your typical job application asks, “Have you ever been CONVICETED [emphasis mine] of a felony?” How did merely being arrested become the equivalent of being convicted of a felony. If that really be the whole story, I wish this woman the best of luck.

federal government itself discriminates against those with arrest records for many, many jobs

and also requires contractors to hire many many workers without arrest records.

This is a question; I’m not attacking you...did the application ask if she had been “arrested”? Or “convicted”? Not sure it’s legal to ask applicants if they’ve merely been “arrested”.

Article states she wasn’t even charged after arrest.

If no one will hire someone who was arrested, it’s welfare or a life of crime for that person.

If her job was limited to cleaning, maintenance, being a crash test dummy, etc., she’d have a point. If the job requires access to clients’ confidential identity data, the company must not put that in the hands of someone the least bit suspect of criminal tendencies. Arrested twice but not tried might mean that she is skilled at hiding her crimes and destroying evidence, or that she is good at hiding behind the race card. Interesting that she is applying for a job that could be ripe for id theft.

Arrested but not charged, likely because she flipped on her then boyfriend. If you have been arrested twice for fraud charges 7 years apart, I wouldn’t want you working for me.

Yes, but it depends on what she was arrested for. Jaywalking? Or fraud, burglary, assault, etc.
