Hmm, that sounds like what I remember, that if they accept any ballots after 8PM, which they did, the entire mail in ballot law is cancelled. (And since many ballots were back dated, there is no way to separate the ballots.)
So why is this the conclusion?
“and the votes that arrived after 8 PM on election day will be discarded. On that basis, Trump will win Pennsylvania.”
Seems to me the conclusion that ALL mail in ballots should be discarded.
It’s a fair point, and one I agree with. However, I guess that depends on the laws regarding mail in ballots that existed prior to PA Act 77.
Another wrinkle to consider is that case brought by another person was actually challenging the constitutionality of the act itself—apparently it violates PA Constitution, or should have been an amendment to the same, and did not follow the required procedures for passing it.
This other tangent was ruled against without even considering the facts, so they are also appealing. So if this case is decided @ US Supreme Court, potential for all mail-in votes to be thrown out (other than preexisting absentee ballot etc.).
So bottom line is that there are 2 lawsuits that could throw out all the mail in PA Ballots.
If Trump gets PA, then it’s only 1 or 2 more states to get the 270 electors.
