I think the Supreme Court should acknowledge that widespread fraud occurred but that now it is impossible to separate the valid ballots from the fraudulent ballots and thus it is impossible to use these ballots to determine the winner. Therefore the assignment of Electoral Colleges electors should be done by the state legislatures per Article II of the Constitution.
P.S. I wouldn’t bet too heavily that the Republican legislatures would assign all Trump electors. Perhaps it’s better that they don’t and the vote moves to the House of Representatives.
I understans your point but I do not want politicians making the decision if at all possible. You are right that GOP legislators would put getting reelected ahead of what is right
