I’ve read that under Colorado state law bear spray is by definition explicitly called out as a nonlethal self defense item. Is this not accurate? I know that bears consider the spray more as an inconvenience.

Doesn't matter. If someone attacks me, I assume he is trying to kill me. I'm not going to ask him what is his intent. Or what are his next planned attacks. Or if he has a knife or gun.
