There's a lot of talk about masks these days since we're all required to wear them when out in public, and one of our viewers called up with a question about them.
The viewer did not want his name used but he owns a gun and he has a permit to carry it. He wants to know if it's legal to wear a mask when you're carrying a gun? He says he has heard you are not allowed to under the law.
Here's what I found out:
Great question and this will give us a chance to dispel a rumor here. There is no law that says you can't wear a face-covering while carrying a gun. In fact, back in June, the Nevada Sheriffs' and Chiefs' Association sent out a letter stating that fact because they said there were so many rumors going around about this.
Part of that statement reads "There have been numerous claims made that it is against the law to wear a face covering and be in possession of a firearm though no citation to this alleged law has been provided. A search of Nevada Revised Statutes and Administrative Code reveals no such prohibition."
This letter was signed by Eric Spratley the executive director of the Nevada Sheriffs' and Chiefs' Association.
Washoe County Sheriff Darin Balaam's name is also on the letterhead as he is the secretary-treasurer of that organization.
So the question's been out there for a while. No truth to the rumor though and yes, you still have to wear a mask even if you're carrying a gun.
Hiyo Silver away!
It is illegal in illannoy. However, the State has graciously announced it won’t be enforced for the duration of the corona mandates.
Depends on the State, not in my state of PA.
BTW, since your from kalifornikator, does any one even have a gun in that communist country?
Picked up my renewed permit yesterday. I was explicitly advised that the California state law regarding masks is qualified with an intention to hide ones identity and therefore does not apply to a mask worn to protect the wearer or the public from a disease.
So if your IDENTITY is hidden, but your intent was to protect the public from chi-com 999999, and you rob a bank and get away with it, it's all good?
Well, ... the DA would have the burden of proving criminal intent in wearing the mask. Otherwise, ... all good.
I’m guessing the fact that you robbed a bank with the mask on would be enough to prove intent. He’s the defendant going to make the argument that I would have robbed the bank with no face covering if I had been allowed to?
also, I’m surprised by how well people recognize other people with these masks on. I’ve been recognized several times and was surprised, even once by a woman that I had only met once before also with the mask on.
Conversely, facial recognition programs are completely thrown off by the masks.
