Disgraced Theranos founder Elizabeth Holmes may argue that she was suffering from a 'mental disease' when she allegedly defrauded investors out of hundreds of millions of dollars with her fake blood testing technology.
The tentative plan for a so-called insanity defense was revealed on Wednesday when the US District Court in San Diego ruled that experts selected by the prosecution could examine Holmes.
Judge Edward Davila authorized the examinations after Holmes' lawyers said they intended to introduce expert evidence from a clinical psychologist 'relating to a mental disease or defect or any other mental condition of the defendant bearing on the issue of guilt'.

I’m more interested in James Mattis’ role in this mega fraud. He vouched for Holmes again and again in speeches and conference and was paid handsomely for it.

It’s a great book. Highly recommend. As for the insanity/diminished capacity angle. Once the defendant finds out that Gov Drs, psychologists and psychiatrists, get to interview you they often back away. The gig is somewhat up.

Many people who accomplish big things are bipolar. Visions of grandeur, and feelings that you can accomplish big dreams help drive some people to achievement them. So she’ll claim that she was defrauded by her own mind. She’s a victim too! Normally guilt without responsibility does not play well in court. But ... California.
I don’t trust government prosecutors, but doubt she would be going for a mental defense — or have even been charged — if there were not hard evidence of criminal intent. Guess we’ll see if she doesn’t plea.

oh, it’s clear she definitely suffers from a mental disease: it’s called sociopathy ... but sociopathy doesn’t excuse her crimes, but instead simply explains them ...

99% of the time, board members are pro-forma rubber-stamps whose main purpose is to provide a false aura of respectability, but without actually doing any actual oversight ...

I know it is a bit motivated reasoning from me because I don’t want Mattis to be guilty, but here:
Maybe the respectability of Bonanni and Foege also worked on Mattis? He knew that he couldn’t understand the science anyway, but since there were two scientists on the board who could, then Mattis figured the science behind the machine is solid.
From there he went with his knowledge of the military - if the machine works then the military could sure use it.
Mattis, like most of the board, was there simply for the big money he was being paid to lend the use of his name for the credibility of the fraudulent company. Others included former secretary of state George Shultz (who disowned his own grandson who was one of the main whistleblower employees that brought down theranos), Henry Kissinger, and former U.S. Senators Sam Nunn and Bill Frist, amongst others. All of these were old codgers who still had Washington name recognition and were simply selling their former fame for a price ...
Bill Frist, a medical doctor (surgeon), should have known better.
