We adopted overseas and had to get an Humanitarian Parole Visa to get the baby back into the states, then go through two years of interviews with INS at the time to get her citizenship. No quick ruling for us.

I think he could have dual nationality....but could be wrong. Many years ago when we did it LEGALLY....and paid through the nose with endless interviews.

I don’t know who recommended this guy to Trump for nomination to a federal district judgeship but we need to investigate nominees’ backgrounds more vigorously. The fact that he got through the Judiciary Committee ON A UNANIMOUS VOICE VOTE and later confirmed by a vote of 92-0 tells me the DemocRATS were tickled pink with him.

If it's a real surrogate (yes) and one US citizen (yes) provides products of conception (yes) then why should it matter whether she was even born on Earth?

Under Jus Sanguinis, why would the child of any US Citizen not also a US Citizen?

I'm suspicious whether this policy would've been applied equally to a single heterosexual American whose daughter was born overseas to a foreign citizen. Based on people I've known, such a child would have dual citizenship.

My question is whether this policy is because of a flaw in the law (purview of Congress) or if it's just policy choice because of someone's politics. I'm also wondering if there's some important, distinguishing fact left out of the article. Based on the facts as presented, I'm with the judge here.

I don’t see how she isn’t born out of wedlock when the biological parents aren’t married to each other. I guess that’s too logical. And then there’s that pesky part, where the biological parent has to have lived in the U.S. for five years prior to the birth. Why do we have legislatures if the laws they make are just going to be ignored?

It might have been at one time, FRiend. But now we live in an upside down World. Everything that was once legal is now illegal. Everything that was once is now legal. It is confusing as hell to me. I just try to stay out of the way. And read all of Humble Gunner’s posts I can.

If this is the rule, get ready. Every child born from foreign women that were impregnated by American serviceman during conflicts overseas are officially citizens. And they aren’t anchor babies as they were not born on US soil. And the hundreds, if not thousands, of children born anywhere in the world to an American citizen mother or father since the passage of the 14th amendment in 1868 can now come home with a brand new passport marked citizen.

But if sperm or egg is considered the qualifying of a person’s citizenship, how can anyone with a DNA tract that matches an American citizen anywhere in the chain, not be an American citizen? That means everyone in the world is related to everyone in the US. So everyone is a citizen. After all, we all came from somewhere back in time. Slippery slope isn’t it?

So what this means is:

Anyone who is currently a citizen that creates a contract to have a child born FOR them in any country on planet Earth will have a new little citizen...who has nothing to do with them except they pre-purchased it.

Can see a brisk business in this. Millions and millions. Undoubtedly based on the foreign parents paying the citizens for the contract, not the other way around. Eventually the little slave will be able to get them here, because we know another judge will rule that it’s his/her/its right.
