Ok. There is a "pandemic" of sorts going on. And you, or your Health Departments have taken action over this, in terms of making "orders" or "laws" or whatever you wish to call them.
In many cases they seem to make sense, at least if we accept that this coronavirus was as lethal as say smallpox was to the west during the colonizations of America.
And this was accented by alot of news media who acted like lapdogs and followed your orders to the teeth and focused on the violators, etc.
So my question is: Are these "orders" laws or not? Simple question, right? You can answer that one.
And the answer is....
No. They are NOT laws. They are at best, suggestions.
The reason is a simple understanding of what a government is, the separation of powers doctrine, and what is or is not PROMISED to the people by THEIR CONSTITUTION!
In Article 4, Section 4, it states... "The United States shall guarantee to every State in this Union a Republican Form of Government..."
So what is this guarantee and how does it affect your "orders"?
It is a guarantee that each state shall have three distinct bodies. It will have a governor, who is responsible to make sure laws are executed properly. It shall have a judicial system that can alleviate disputes. But mostly it means that each state shall have a legislature, who pass laws at the will of the people.
That last statement is irrefutable. All states MUST have an active legislature made up of the people of the state.
They can, in times of emergency, pass this power to the governor, but they MUST MEET and formalize the adoption of his recommendations into law at some time or the "orders" are simply his best wishes.
Period.
So for all you governors who have been watching Fauci and Birx etc, etc, etc and trying to play the game you are simply WRONG!
