A New York college athlete has sued Disney World after an electric scooter driver ran into him and severed 97 per cent of his Achilles tendon in 2018. In a lawsuit filed against the company, David Maynard, of Utah, said the incident cost him his basketball season after he was forced to undergo surgery and extensive physical rehabilitation. According to the Orlando Sentinel, the suit is seeking more than $30,000 and was filed last week in Orange Circuit Court.

Remember that scene in Pet Sematary where Herman Munster got his Achilles tendon cut with a scalpel? I cringe every time I think of that.
According to the Sentinel, a Disney spokeswoman said the matter is between Maynard and the scooter driver.
That spokeswoman is going to be the punchline at every tort lawyers banquet from now til the end of time...
That’s what insurance is for. He’s lost no monies by not playing....
I would guess Disney has a contract they make you sign when you rent a scooter that has some pretty strict language regarding YOUR responsibility for whatever you run into.
And as for training? “Here’s how you make it go and stop. This is how you turn it”
How much “training” do they have to give you? A multi-hour course with a driver test like the DMV?
What basketball season? He needs to aim his lawsuit at the Chicoms.
The knee is the Achilles heel of the leg.

Hes lost the right to be seen, public appearances, women throwing themselves at him, self esteem, MVP awards.
Worst of all, hes not going to be able to lead his team to the championship, and how awkward would it be NOW to dream of saying into the camera (after the game winning basket) Im going to Disney World!?
And I havent even mentioned pain and suffering..
Im going to guess that the victim didnt sign a contract limiting Disneys liability if someone driving a Disney-owned-and-maintained scooter should run him down.

$30,000? Pay it and move on.
I recall reading a post from years ago about a FReeper who was attacked by 4 yutes in some SE Asian country and used his Spyderco folder on their Achilles to deter the behavior.

Who paid for the surgery and rehabilitation? Must of been expensive.
General Liability coverage, I’m sure Disney has multiple millions of layers.
I’m sure he had insurance....both through his parents and the college.
I have ridden my Harley through a crowd of 300,000 OTHER Harleys in the Pentagon Parking Lot to grab my position in the Rolling Thunder parade. Nine years in a row.
And never hit anyone.
Driver’s fault.
I hadn’t been to an amusement park for several years, and when I went at Christmas I was shocked by the number of scooters and rudeness of the drivers. Some of them are oblivious. I’m surprised this doesn’t happen more.
My friend who goes there all the time says sometimes they’ll be 3 abreast and clog up the whole walkway.
