Former Watergate prosecutors urge judge to buck Justice Department and not dismiss Michael Flynn case

(CNN) Sixteen former Watergate prosecutors have told a federal judge he has the authority to sentence former Trump national security adviser Michael Flynn to prison despite the Justice Department's effort to toss the case.

The filings add prominent voices to the backlash against Attorney General William Barr's softening of criminal prosecutions against President Donald Trump's associates.

In legal memos sent to the court on Monday and obtained by CNN, the former prosecutors essentially laid out the legal footing they believe Judge Emmet Sullivan has to reject the dismissal request and sentence Flynn, who had pleaded guilty to lying to the FBI.

They compared the current situation at the Justice Department to Watergate, the scandal and criminal investigation that led to the President Richard Nixon's resignation.

The group, calling themselves friends of the court or "amici" in legal parlance, "experienced the 'Saturday Night Massacre,' during which an honorable Attorney General and an honorable Deputy Attorney General resigned or were dismissed rather than obey the instructions of a self-interested President to frustrate the work of an independent Special Prosecutor," they wrote to the judge.

We do however have recourse and we are winning through prayer and President Trump.

Let’s not surrender that. Let’s double our efforts and let elected representatives in DC and at the state level know we demand better and stronger penalties for intel interference in our country’s elections.

The “just like Watergate” scandal was the Obama administration’s politicized abuse of power, attempting to produce an internal coup based on what they knew was a hoax - which it’s holdover DOJ officials continued right into the early days of the Trump administration.

Not so much a step as a point of evidence. The courts are highly political, and have been so for decades. Since at least FDR court-packing threat.

The legal process is pretty much outcome first, reasoning second. There are sufficient precedents (and few people check if they really stand for the proposition claimed) to justify any outcome the judge or appellate panel chooses.

I expect this Judge to sentence Flynn.

Absent DOJ prosecution (People of the United States of America), he is all out of options. Powell nipped any Special Prosecutor in the bud in her motion.

This derp lop is just trying to muddy up the DOJ, Flynn, and Trump before he dismisses with a bunch of derp state propaganda submitted as some kind of faux legalism.

Somebody has to play powerful word games though.

What has Flynn pled to after the prosecutor says “no crime?” Assuming for sake of argument Flynn lied, that lie is not material, so there is no crime.

The plea is “guilty to the information” (there was no indictment). Okay, fine, but the information is fatally flawed. The facts in the case don’t support a finding of materially false statement. That’s what the Gov’t Motion to Dismiss lays out, with facts and evidence.
