Former Watergate prosecutors urge judge to buck Justice Department and not dismiss Michael Flynn case

(CNN) Sixteen former Watergate prosecutors have told a federal judge he has the authority to sentence former Trump national security adviser Michael Flynn to prison despite the Justice Department's effort to toss the case.

The filings add prominent voices to the backlash against Attorney General William Barr's softening of criminal prosecutions against President Donald Trump's associates.

In legal memos sent to the court on Monday and obtained by CNN, the former prosecutors essentially laid out the legal footing they believe Judge Emmet Sullivan has to reject the dismissal request and sentence Flynn, who had pleaded guilty to lying to the FBI.

They compared the current situation at the Justice Department to Watergate, the scandal and criminal investigation that led to the President Richard Nixon's resignation.

The group, calling themselves friends of the court or "amici" in legal parlance, "experienced the 'Saturday Night Massacre,' during which an honorable Attorney General and an honorable Deputy Attorney General resigned or were dismissed rather than obey the instructions of a self-interested President to frustrate the work of an independent Special Prosecutor," they wrote to the judge.

In case you were under any illusion that the Watergate prosecution was anything other than a partisan hit job on the President of the United States, the Democrat prosecutors are now coming out foursquare for the abuse of executive power in order to rig elections.

Obviously there is nothing in front of the Supreme Court...today. You can bet there will be if Sullivan disallows the dismissal. It was only days ago the Supreme Court smacked the 9th Circus down 9-0 for doing essentially the same thing.

I was about to post similar. It won’t be the supreme court though, this thing will be booted by an appeals court. Not good for the general short term, but maybe good because the dirty FBI deeds will get more public play as this thing drags on.

The continuation of this case by political prosecution (and that’s what this is) IS corruption at its highest level

Sullivan's position is that the prosecution is over.

He appears to be wrong on the law (it IS over, but DOJ has standing to make the motion to dismiss and Sullivan MUST rule on it BEFORE taking victim impact statements on sentencing) - but he's technically not continuing prosecution.

Similar but you’re correct on the Supreme Court decision. However this is a federal criminal case not civil.

If an appeal is required, and I hope it’s not necessary, it goes to the federal court of appeals I believe. The Supreme Court should not need to ever see it.

The case law should be more than adequate to end the matter but Judge Sullivan should not give them such unnecessary chores.

It would be a gross injustice to the rule old law and an innocent man in General Flynn.

Yes, very good. I was 24 the day Nixon resigned, and no one was a more passionate anti-Nixon Watergate hound than I was. Live and learn, I guess.

But to your point - Watergate was much, much more than a "media coup". In fact, pushing CIA-connected Woodward out front with Bernstein and concealing Mark Felt served the interests of the real conspirators - the CIA, the FBI, and foreigners who in 1972 just as in 2016 had their long-range plans upset by the results of an American Presidential election.

Then, as now, congressional Dems went right along without a thought to right and wrong. Then, as now, the "networks" were USED as a megaphone to drip out a false conspiracy story, chapter by chapter, right through the impeachment and resignation grand finale.

Except THIS time, the people had many more sources of information than NYT-WAPO-ABC-NBC-CBS, Walter, Chet, and David were in their graves, and Mitt Romney turned out to have ZERO influence on his fellow RINOs, who by some miracle held the line instead of taking their normal swan dive.

No, this was Watergate 2.0, but the "media" then as now were not the drivers - they were whoring themselves out, again, to a shadowy Deep State conspiracy organized who knows where but issued their marching orders through the ultimate Deep State pawn his own self - BHO.

At least they didn't take up the Dallas option - not yet, anyway.

I have always respected Judge Sullivan, but it appears that any of us are susceptible to a Judge Ito moment when we see the media and cameras focused on US! Little ole me. Lance Ito became a complete clown for the LA and national media in the OJ case. Made that trial interminable. No wonder the jury lost its mind.

Wondering if that so called Obama meeting he had was a strategy meeting in which to use Flynn again as a pawn and try to neutralize Barr since the fire is getting so close to Obama, Comey, etc. Saw where Holder was on TV. Going to get interesting.

By his order admitting amicus curiae briefs, Judge Sullivan has politicized his court and hastened the demise of our constitutional system.

The problem is the politicization of Judge Sullivan's court is only one more step in a long and sorry journey toward the politicization of our entire court system. No more proof of that is needed than the confirmation hearings of Judge Bork, Justice Thomas and Justice Cavanaugh. These hearings did not politicize the court, rather these hearings were political because the court had already been politicized. They were the inevitable political reaction of one branch of government to the politicization of another branch.

Hat tip to Sen. Sasse for spelling this out during the Cavanaugh confirmation hearings and taking the opportunity to educate those Americans willing to listen about the serious politicization of confirmation hearings and why it happened.

The Flynn case stands as a token of the politicization of federal criminal law by federal criminal agencies. Their reason to corruptly act against Flynn? To achieve a political end. The ends were corrupt and the means were corrupt and all for politics.

Judge Sullivan, unfortunately, has by previous remarks from the bench concerning Gen. Flynn revealed himself to be less than disinterested in this highly political law case. Already suspect, Sullivan has made himself an object of partisan rancor.

I wonder how our chief justice who is so terribly sensitive about the integrity and authority of the courts is reacting to this next step in the journey?

This POS Judge has a long time grudge against Flynn. The Judge is joined at the hip with Obama and Holden. He’s determined to break Flynn. God bless Sydney Powell and the work she’s doing to defend Powell. the case should be removed from Sullivan if that’s possible.

The judge is a fool.

DOJ “should” proceed with the case, presenting a solid defense of Flynn as their prosecution. Then let Flynn’s defense team put on a solid defense of Flynn as a rebuttal.

If the leftist whacko’s continue after that, rope is cheap; gravity is free.
