The State Attorney’s Office 6th Circuit just DROPPED their case against my client Galen Wood—the first Floridian to be arrested for opening a “non-essential” business.

I think almost all of these “criminal cases” as well as the civil charges for fines or licenses will be thrown out.

You cannot claim a “liquor store” is an essential business and declare that any other business is not. Who decides this and under what basis?

Thanks to HotHunt for the above great visual!

If people want to stay home, let them! NO ONE wants to force them to go out!

Easy - if you as a small business owner don’t feel safe - Don’t open!

Easy - If you as an individual don’t feel safe with things opening up - Don’t go out.!

Is there an official DEFINITION of ‘essential business’? ...not just a list, that is just arbitrary opinion.

Ask each business owner if they believe their business is essential to them? ...we all know the answer. So it’s just opinion, those in power just don’t see it as essential TO THEM.

“1866....50 states...really?”

Why? A former idiot president said there are 57 states..

There were 50 States in 1866? Or was that second part referring to something modern.

In short, the arrest and threat of prosecution was executed to scare everyone else into staying “in-line” to the demands of the horrible leftists in government.

This is also more proof that these ‘orders’ are illegal and any arrest for defying them can never be upheld by a court.

We have a horrible, rotten political class in this country.

Outstanding in every respect, Mr. Sabatini ... the courage, the strategy and the result! Heartfelt congratulations to you and to Mr. Wood on a well-conceived and executed plan.

I recall when Rush used to talking about the
“Bill Clinton Library/ Massage Parlor”.
I guess that would be seen as an ‘essential business’ by today’s partisan standards.

“if you as a small business owner don’t feel safe - Don’t open!”

So Small Business Owners are headed toward 60 days with NO INCOME and they still have bills coming in.......how long before they go under?

Who is responsible?

If they are a business that is able to SOCIAL DISTANCE should that make a difference?

Why is this CONSTITUTIONAL?

I would love to see federal prosecutions against many governors and mayors on the basis of the Milligan case, followed by civil suits against those individuals under Title 42, Section 1983 (deprivation of civil rights under color of law).

The federal guidance for states is here:
https://www.cisa.gov/identifying-critical-infrastructure-during-covid-19
It is more about what is defined as essential to the federal govt than what is non-essential, which is left up to the state or local govt.

Never mind; Milligan stands for the proposition that military law cannot be enforced against civilians in a peaceful zone when they are unconnected to the military in any way. However, it is also clear that it stands for the proposition that our civil rights, other than the Writ of Habeas Cirpus, cannot be superseded in a time of emergency, otherwise our laws would have no meaning and lead to chaos or despotism.

I stand by suing the give and other officials under 42 U.S. Cide Section 1983.
