Residents locked out of apartments in Bexar County

BEXAR COUNTY, Texas (KXAN) — Bexar County is investigating after nearly 50 residents were locked out of their apartments at a San Antonio complex. They say they found their doorknobs bolted when they returned home on Monday. That’s despite a local moratorium on evictions that’s currently in effect due to the COVID-19 pandemic.

“It is sad. It is sad when somebody put a key on the door, even though they don’t have money for two or three months. Right now, we don’t need that,” says Luis Falcon, who son was locked out of his apartment. “This is the first flagrant violation we had of this, and we’ve asked the district attorney and other law enforcement to look into it and see what kind options we have against the company who did that,” says Bexar County Judge Nelson Wolff.

The City of San Antonio has a program that helps residents cover their housing costs. In Travis County, evictions are prohibited until May 8 and those in violation could be fined $1,000 and/or face 180 days in jail. County Judge Sarah Eckhardt issued the order, which halts evictions, unless a tenant or a member of their household poses “an imminent threat of physical harm to the property owner, the property owner’s employees, or other tenants, including other tenants within the household,” or if there is criminal activity happening there.

I got lucky with getting my lease violating-non-rent paying tenant. I went up there and let him know I wasn’t leaving. He got his cell phone out & started calling his buddy with a truck. THANK GOD!
Since I had a separate page making it clear I had total access during renovations...he was stuck.

Wow. No mater the circumstances of the individuals locked out, what the management of that complex did was cold.

Gov’t orders a shut down then orders property owners to bear the financial burden that any idiot could have seen flowing from it. Thats a nice gig, sitting above everyone and giving any damned order you please. How the hell is this fair. Gov’t shifts the blame for its stupid policy on to landlords and God knows who else, making THEM the bad guy.

I too was also wondering about that small glitch in contract law. I also wonder where a County Judge (aka County Commissioner) which is usually not a real judge in the legal sense has any authority to do what was demonstrated here. These bureaucrat type local elected leaders (usually Dimocrats) have let their overpowering thirst for raw power go to their heads.

Governor Abbott issued a statewide order prohibiting evictions.

I’m doubting this TV gerbalsim story for the time being. Will see what local info I can find.

The leasing company had to let the deadbeats back so SA has free rent for everybody. I would post a link but it’s too depressing.

Who’s right or wrong in this story aside, I have a rhetorical question. Does no one set money aside and or have savings for an emergency such as this? Everybody lives paycheck to paycheck nowadays? Ok that’s two questions but still....it hasn’t been that long yet and people already can’t make ends meet. I could see it if we were a few more months in.

And unless you went through the court eviction process, you could be seeing huge fines for an constructive self-help eviction.

Judges will come down especially hard on you if your state/ county/municipality has a covid-19 eviction-freeze order.

Just saying. I’m suing my landlord for a shit-ton of money for an illegal self-help eviction. Only difference is I was fully paid until the end of May.

A vast majority of Americans, including myself never had the financial stability to save 3 to 6 months rent or expenses.

I managed to save 2 months. Gone now to maintain my mortgage, rent, car payment and family expenses for the past two months.

Only possessions left in the US are a 2006 shitmobile car, 2 laptops (no resale value, no one wants a 2-year Gaming laptop with an Arabic keyboard), and 2 suitcases full of clothes. That’s it.

30 million Americans suddenly unemployed. Who can plan for that?

Piece of crap Cuomo says no problem, go get an essential job. Yes, he did say that when protesters said they are out of work and need him to open the economy.

What the landlord at the complex did was highly illegal. It was a self-help eviction, illegal in all states. Only legal process is to go through the proper legal channels and procedures. Landlords are not allowed to bypass the process if the courts are closed. That’s the law.

I see the property management company getting sued big time in civil and criminal court for this.
