Fox News contributor Andrew Napolitano, a former judge, recently penned an article with the provocative title Coronavirus fear lets government assault our freedom in violation of Constitution.
Although Napolitano is right to be concerned, President Donald Trump and other federal, state, and local officials appear to be acting within the bounds of the Constitution in responding to the severe threat posed by spread of the new coronavirus disease, which health officials call COVID-19.

It seems to me that our freedoms were taken away very easily and suddenly, with little resistance from the free people of the USA.
Andrew is not the sole arbiter of the us constitution.
I do not look to him as my reference.
here’s the thing about legalities. Those with the most firepower usually win.
Public health emergencies have been consistently upheld by the Courts. The Constitution is not a suicide pact.

I guess i mean the author of this piece saying its all legal. I think the gov’s and locals doing drstic things and closing gun shops and keeping abortion butchers open is the stuff that go beyond comstitutional authority.
It’s fascinating watching all these liberals suddenly concerned about constitutional rights.
And Cuomo is now taking up states rights.
Too bad they don’t know when to pick their battles.

I’m in a “safer at home” state, courtesy of our new Democrat governor.

I know he used to be trustworthy and at least leaned conservative.
I forget what he did or said that upset everyone some time back, and as a result I hesitated to post this because he’s involved.
But he’s on my side on this issue, so for a few minutes here, I love the guy. :-)
State governors have tremendous power during health emergencies. You really wouldn’t want them not to. You can argue if this is a real health emergency or not, but the governor gets to make the call. This may be a once-in-a-lifetime event, but for the rest of our lives we’ll take our votes for our state’s governor a bit more seriously.

I heard some news today that Trump mentioned the idea and Cuomo was saying he didn’t think that was legal.
He is probably correct, but the hysteria has made these double extra ordinary times.
I still lay all of this on not enough testing being done on samples of the general population to be able to tune the models to more accurately predict where we are headed and thus drive gov’t actions.
We are in Illinois, God help us. Basically everything is closed down. We even got an email from our private gun club this morning saying theyve closed all the ranges. The place is 300 acres and its almost impossible to get within 6 feet of anyone when shooting.
We dont like it at all either. But we just happen to have a well stocked bar in our home, the preps for just such an eventuality have been laid in for years, and Mrs L are both working from home and have paychecks.
So we are fortunate in many respects. Im next to the love of my life with a drink in my hand and some music playing.
This too shall pass.

It’s not legal. The govt can’t make decisions for people about work or church. We haven’t lived by the constitution for a long time though. At times yes but whenever the elites want to push it aside they do. We have a facist govt imo. They control everything and we re merely subjects.
There was little resistance by the American people because most of them think that this is a serious health threat that warrants this kind of response. If enough of the American people decided that these actions were unnecessary then you would see more resistance.
If after this is over the American people decide these steps werent warranted they will vote these politicians out of office.
I think we are going to need to seriously visit this topic when this crisis is over.
What “emergency powers” should anyone in government possess”
350 million Americans locked in their homes indefinitely? What if this lasts 3 months? What if there is a 2nd wave as some are predicting and last lasts 3 months? What if this happens every year? Do we start issuing this order every flu season to stop influenza as well? So far it’s killed far more than corona.
If it’s constitutional to ban you from leaving your home during an emergency is it also constitutional to do so when there isn’t an emergency?

I think I’ve heard the Progressives use that very phrase in relation to the 2nd amendment.
