They got him doing 45mph in a 40. He blew a .079 on the breathalyzer. .080 is the legal limit.

Nothing. It is a presumptive value. At that value and above you are automatically presumed drunk. You have to prove the test inaccurate to skate. The law actually allows for one to be hit with a DUI if you cannot pass the field sobriety test...which he did not

IIRC, if you are between .03 (?) and .07, you still get charged with DUI.
Not in Texas. Once you blow a .08, they will charge you. If you're below that, it depends on the officer's discretion as to whether or not you constitute being 'too impaired'. It's not automatic at that point.
You can blow a .00 and still get a DUI, if you're hopped up on any drugs, either illegal or including legal prescription stuff.
