Jussie Smollett's Bid To Get Charges Thrown Out RejectedBy Illinois Supreme Court

The Illinois Supreme Court rejected former "Empire" star Jussie Smollett's request to throw out charges that accuse him of staging a racist, homophobic attack in Chicago.

The ruling came Friday, along with the court's decision rejecting the actor's effort to remove the special prosecutor in the case.

Smollett’s lawyers argued in an emergency petition that Cook County Circuit Judge Michael Toomin overstepped his authority and misinterpreted the law when he ordered the appointment of a special prosecutor.

The court did not explain its decision to reject the arguments by Smollett’s lawyers.

Smollett. 37, was initially accused by Cook County prosecutors of falsely reporting to police that the alleged phony attack was real. Sixteen counts of disorderly conduct originally filed against him were dismissed and Toomin found Smollett’s first prosecution was invalid.

After another investigation by special prosecutor Dan Webb, six counts of the same charges we filed against Smollett, to which he pleaded not guilty last week.

Smollett, who is black and gay, told police that two masked men attacked him as he was walking home in the early hours of Jan. 29, 2019. He said they made racist and homophobic insults, beat him and looped a noose around his neck before fleeing, and that at least one of his attackers was a white man who told him he was in “MAGA country,” a reference to President Trump’s campaign slogan, “Make America Great Again.”

Illinois Supreme Court pretty much gave Juicy a big F-you with a one word judgement:

"Today the following order was entered in the captioned case: Emergency motion by Movant to stay proceedings in the Circuit Court of Cook County, in case No. 20 CR 3050, pending disposition of motion for a supervisory order. Denied."

Order entered by the Court. Theis, J., took no part. Very truly yours, Clerk of the Supreme Court

I hope the special prosecutor links Kamala Harris to the staging of the “crime,” and Michelle Obama and friends for obstruction of justice for pressuring to get the charges dropped.

I’d prefer H->!, Comey, Brennan, Clapper, et. al. getting the book thrown at them.

Juicy Smoolyeah's attorneys tried claiming "double jeopardy" to get the charges thrown out.

Stupid lawyers! Everyone knows double jeopardy only applies if he'd have gone to trial and either plead out, been convicted or been exonerated.

None of those happened. There was no double jeopardy.

I cannot wait for Juicy Smoolyeah to go to prison. About time at least one crook in this state went to the big house.

Maybe he’d get some traction with the “do you know who I am” argument.

...racist, homophobic attack...

The court did not explain its decision...

One sort of follows the other. Leftist class warfare to divide America. The meaning of "racist, homophobic attack" is unexplained and explainable.

This guy couldn’t just file a false police report. Something that couldn’t be proven or disproven. It would have been quickly forgoten. A fine at most. Probation. No. He had a script. He had supporting actors. He had props. He lied and continues to lie. He deserves jail.

I am sure he could have had this settle for 100 hours of community service, a apology letter to Chicago PD and 120K repayment to the Chicago PD for resources wasted investigating his hoax and everyone would have been happy

Sure we would want blood, but over all, it would have been a settlement and admission of guilt which is rare among the left.

This fool is going to spend 120K easy just in lawyers now.

As guilty as this fag-hoaxer is, I’m almost willing to grant him some leniency IF he will implicate the coaches and financial backers he no doubt had which induced him to concoct this false witness, i.e. lie. I’m willing to bet it was pretty high level.
